.139 <br /> <br />June 10, 1975 <br /> <br />~he following reports from the City Manager were presented: <br /> <br /> 75-235 "Consideration of an ordinance on first reading to appropriate $12,500 from <br />the Capital Improvement Fund for improvements in Merrifields Section 5-c. <br /> <br /> This appropriates the funds received as payment on a letter of credit on behalf of <br />Merritt Construction Company for the City to proceed in completing improvements in the <br />subdivision agreement. The funds have been received by the City and deposited to the account <br />for the accomplishment of this work. The City Manager recmmmends adoption on first reading. <br /> <br /> On motion of Mr. Elliott and seconded by Mr. Holley, the following ordinance was ap- <br />proved on first reading, and by unanimous vote: <br /> <br />"AN ORDINANCE TO APPROPRIATE $12,500 FROM THE CAPITAL IMPROVEMENT FUND FOR <br />IMPROVEMENTS IN MERRIFIELDS, SECTION 5C." <br /> <br /> 75-236 "Consideration of an ordinance on first reading to appropriate $70,000 from <br />the Port Facilities and Economic Development Fund for purchase of property for economic <br />development. <br /> <br /> This appropriation will provide the necessary funds for the purchase of land that will <br />be resold for commercial or industrial use in the Pinners Point area. The City Manager <br />recommends adoption on first reading. <br /> <br /> On motion of Mr. Barnes and seconded by Mr. Early, the following ordinance was approved <br />on first reading, and by unanimous vote: <br /> <br />"AN ORDINANCE TO APPROPRIATE $70,000 FROM THE PORT FACILITIES AND ECONOMIC <br />DEVELOPMENT FUND FOR THE PIYRCHASE OF PROPERTY FOR ECONOMIC DEVELOPMENT." <br /> <br /> 75-237 "Consideration of an ordinance on first reading to approve a contract <br />the City of Portsmouth and Virginia Electric and Power Company for the purchase of <br />and services for municipal purposes and to authorize the execution thereof. <br /> <br />electrici~ <br /> <br /> This contract outlines the negotiated agreement between the municipalities and the <br />Virginia Electric and Power Company for the period beginning July 1, 1974 and ending June 30 <br />1976. Since this contract has already been in effect 11 months, it is recommended that this <br />ordinance be adopted on first and final reading in order that the contract can be executed <br />immediately. The City Manager recommends adoption." <br /> <br /> On motion of Mr. Early and seconded Mr. Elliott, the following ordinance was adopted, <br />and by the following vote: <br /> <br />"AN ORDINANCE TO A~f~ROVEH~HBOR~TR~HBB FORM OF CONTRACT BETWEEN THE CITY OF <br />PORTSMOUTH AND VIRGINIA ELECTRIC & POWER COMPANY FOR THE PRRCHASE BY THE CITY <br />FROM SAID COMPANY AND THE FURNISHING BY THE COMPANY TO SAID CITY OF ELECTRICITY <br />AND ELECTRIC SERVICES FOR ALL OF THE ELECTRICAL RE~UUIREMENTS OF THE CIT7 FOR <br />MUNICIPAL PURPOSES, AND TO AUTHORIZE THE EXECUTIVE THEREOF ON BEHALF OF THE <br />CITY.'-~ <br /> <br />Ayes: Barnes, <br />Nays: None <br />Abstaining: 0asr <br /> <br />Early, Elliott, Holley, Davis <br /> <br /> 75-238 "Consideration of an ordinance on first reading pertaining to Council procedur~ <br />for adopting ordinances and resolutions. <br /> <br /> This ordinance will amend the Code of the City of Portsmouth by permitting ordinances <br />and resolutions ~hich do not appropriate money, impose taxes pr authorize the borrowing <br />of money to be finally approved upon first reading. Ordinances which do appropriate money, <br />shall continue to have a first and final reading. Inasmuch as Section 2-61 of the City <br />Code permits reconsideration of matters before the Council by motion, it is recommended that <br />this improvement to the procedural ordinance be adopted. The City Manager recommends adoptio <br />on first reading. <br /> <br /> On motion of Mr. Early and seconded by Mr. Elliott, the following ordinance was approved <br />on first reading, and City Attorney be directed to add matters pertaining to zoning to have <br />two readings,.was adopted by unanimous vote: <br /> <br /> "AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, BY <br /> AMENDING SECTION 2~17 THEREOF P2RTAINING TO COUNCIL PROCEDURBS FOR ADOPTING <br /> ORDINANCES AND RESOLUTIONS." <br /> <br /> 75-239 - "Consideration of an ordinance on first reading amending C~apter 24 of the <br />Cod? of the City of Portsmouth, Virginia, by enacting Article 7 to be entitled swimming pool~, <br />and enacting Section 24-150 of the City Code adopting by reference Article 2 of Chapter 34 <br />of the City Code; adopting fees for publicly-owned swimming pools; and authorizing the <br />adoption of rules and regulations.~ <br /> <br /> This ordinance adopts the operation procedures as set forth for private swimming pools <br />for all publicly-owned swimming pools. It also establishes a fee of 35~ per person for <br />admission to all publicly-owned and operated ~wimming pools. This ordinance will permit <br />the Recreation Commission through its Director to adopt such rules and procedures that are <br />necessary for the safe operation of all public pools. A letter from the Chairman of the <br />Parks and Recreation Commission recommending the establishment of the admission fee is at- <br />tached for your information.
