<br />Use Permit 75-2 Petition of the Congregatinnal Christian Assembly
<br />
<br />Reverend James R. Murphy of the Congregational Christian Assembly spoke.
<br />
<br /> On motion of Mr. Early and seconded by Mr. Barnes, the following resolution was a

<br />"A RESOLUTION GRANTING A USE PERMIT TO OPERATE A DAY NURSERY ON DEEP
<br />CREEK BOULEVARD NEAR ITS INTERSECTION WITH SHILOH PLACE.
<br />
<br /> WHEREAS, the Congregational Christian Assembly has made application pursuant to Section
<br />-.~76~ of the Code of the City of Portsmouth, Virginia, 1973, as amended, for the granting
<br /> of the use permit as hereinafter described; and
<br />
<br /> WHEREAS, the applicant and the Planning Director have done all things required to
<br />be done in connection with said application, and the Planning Commission has recommended
<br />the granting of said use permit on condition.
<br />
<br />NOW, THEREFORE BE IT RESOLVED by the Council of the City of Portsmouth, Virginia:
<br />
<br /> a. That the use for which the use permit hereinafter described is sought (1) will
<br />not adversely affect the health or safety of persons residing or working in the neighborhood
<br />of the proposed use, (2) will not be detrimental to the public welfare or injurious to
<br />property or improvements in the neighborhood, and (3) will be in accord with the purposes
<br />of the Zoning Chapter of the City Code.
<br />
<br /> b. The City of Portsmouth is hereby granting a conditional use permit pursuant
<br />to Section 40-75(b)~ of the City Code to operate a Day Nursery upon conditions hereinafter
<br />set out on the property described as follows:
<br />
<br /> BEGINNING on the east side of Deep Creek Boulevard 267 feet, more or less,
<br />from its intersection with Shiloh Place; thence easterly 153 feet, more or less
<br />to a point; thence south 44 feet, more or less to the Williams Court property
<br />line; thence easterly along said line 60.feet to a point; thence north 73.77
<br />feet to a point; thence westerly 182 feet, more or less to the east right-of-way
<br />line of Deep Creek Boulevard; thence southerly.along said right-of-way 60 feet;
<br />more or less to the POINT OF BEGINNING.
<br />
<br /> c. The condition upon which this use permit is granted is that Petitioner before
<br />commencing the use of said property as a Day Nursery, shall comply~With all Federal,
<br />State and City Ordinances applicable."
