253 <br /> <br />November 25, 1975 <br /> <br /> .(1) In the event any member of council during his term of office shall desire <br />to be a candidate for the office of mayor, he shall be eligible to do so, but shall tender <br />his written resignation as a member of council by the final date for the filing of petitions <br />a~d"no~ic~ of~-~eptai~e as specified herein, such resignation to be effective the thirtieth <br />day of June of such election year. Such resignation shall state the councilman's intention <br />to run for the office of mayor and shall require no formal acceptance by the remaining <br />members of council and shall be final and irrevocable as of the date it is tendered. <br /> <br /> (2) Th~ remaining two year term of office of any councilman who has resigned <br />for the stated purpose of running for the office of mayor shall be filled at the same <br />suceeding general municipal election in which the office of may is elected. After such <br />resignation such two year term shall be filled by the candidate for councilman receiving <br />the next highest vote to those candidates declared elected to the office of councilman pursuan <br />to subsection (b) of this section. Such two year term shall begin on the first day of July <br />next following the date of such election, <br /> <br /> (c) The city clerk shatl.notify::alt>su~cessful{camdida,~s~of what~t-is:.necessary.for <br />them to do to qualify for office immediately after their election has been certified by <br />the proper officials. <br /> <br />Section 3.04. Vacancies in office of councilman. <br /> <br /> Vacancies in the office of councilmen, except for resignations to run for the office <br />of mayor, shall be filled for the unexpired portion of the term by majority vote of the <br />remaining members of the council, lot, if the council shall fail to fill a vacancy in its <br />membership within sixty days of the occurrence of the vacancy, by appointment by a majority <br />of the judges of the Circuit Court of the city. If any person elected to the council at <br />a regular municipal election sh~tl fail to take the oath of office prior to the first day <br />of July following such election, he shall be deemed to have declined the office, and his <br />seat shall be deemed vacant. If any person appointe9 to the council to fill an unexpired <br />term shall fail to take the oath of office within thirty days of such appointment, he shall <br />be deemed to have declined the office, and his seat shall be deemed vacant. <br /> <br />2.
