May 25, 1999 (e) Will be in accordance with the purposes of the City of Portsmouth Zoning Ordinance. 2. That Jawana LaRue is hereby granted a use permit pursuant to Section 40- 43.1 of the Code of the City of Portsmouth, Virginia (1988) for the operation of a child day care facility on property located at 1607-1609 Barren Street, and being more particularly described as: UP-99-04 Beginning at a point 60'+ west of the northeast corner of the intersection Barren Street and Peninsula Avenue; thence, south, 108'+ to a point; thence, west 105'+ to a point; thence, north 108'+ to a point; thence, east 108'+ to the point of the beginning. 3. That this amended use permit is approved subject to the following conditions: (a) Occupancy of the facility at any time shall be limited to a maximum of twelve children with no more than five children being under the age of 2 ¼ years. (b) The applicant shall maintain residency within the facility. (c) The hours of operation shall be from 7:00 A.M. through 6:00 P.M., Monday through Saturday. (d) Outdoor recreational activities shall be limited to the hours between 10:00 A.M. and 6:00 P.M. The number of children allowed outdoors at any given time shall not exceed eight. (e) Drop off and pick up of children shall be limited to the front driveway pad. (f) Staff parking and long-term visitors shall be limited to the rear parking facilities. (g) On-street parking shall be prohibited. (h) The facility shall comply with all applicable federal, state, and local codes, ordinances and regulations and shall obtain and maintain in effect all necessary licenses and permits. The applicant shall obtain a Certificate of Use and Occupancy from the Building Official (i) The facility shall be inspected annually by the Department of Social Services, the Fire Prevention Bureau, and the Public Health Department and shall correct any noted deficiencies. (j) All taxes and fees on the subject property and operation shall be paid when due. 4. REVOCATION OF PERMIT: Violation of any of the above conditions may serve as grounds for revocation of the use permit by the City Council." 99-111 (c): "A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING USE PERMIT (GHP-99-01) TO PERMIT SIX CONDOMINIUM RESIDENTIAL UNITS ON SANDIE POINT LANE.
