May 25, 1999 <br /> <br /> (e) Will be in accordance with the purposes of the City of Portsmouth <br />Zoning Ordinance. <br /> <br /> 2. That Jawana LaRue is hereby granted a use permit pursuant to Section 40- <br />43.1 of the Code of the City of Portsmouth, Virginia (1988) for the operation of a child <br />day care facility on property located at 1607-1609 Barren Street, and being more <br />particularly described as: <br /> <br />UP-99-04 <br /> <br /> Beginning at a point 60'+ west of the northeast corner of the <br />intersection Barren Street and Peninsula Avenue; thence, south, <br />108'+ to a point; thence, west 105'+ to a point; thence, north 108'+ <br />to a point; thence, east 108'+ to the point of the beginning. <br /> <br />3. That this amended use permit is approved subject to the following conditions: <br /> <br /> (a) Occupancy of the facility at any time shall be limited to a maximum of <br />twelve children with no more than five children being under the age of 2 ¼ years. <br /> <br />(b) The applicant shall maintain residency within the facility. <br /> <br /> (c) The hours of operation shall be from 7:00 A.M. through 6:00 P.M., <br />Monday through Saturday. <br /> <br /> (d) Outdoor recreational activities shall be limited to the hours between <br />10:00 A.M. and 6:00 P.M. The number of children allowed outdoors at any given time <br />shall not exceed eight. <br /> <br />(e) Drop off and pick up of children shall be limited to the front driveway <br /> <br />pad. <br /> <br />(f) Staff parking and long-term visitors shall be limited to the rear parking <br /> <br />facilities. <br /> <br />(g) On-street parking shall be prohibited. <br /> <br /> (h) The facility shall comply with all applicable federal, state, and local <br />codes, ordinances and regulations and shall obtain and maintain in effect all necessary <br />licenses and permits. The applicant shall obtain a Certificate of Use and Occupancy <br />from the Building Official <br /> <br /> (i) The facility shall be inspected annually by the Department of Social <br />Services, the Fire Prevention Bureau, and the Public Health Department and shall <br />correct any noted deficiencies. <br /> <br />(j) All taxes and fees on the subject property and operation shall be paid <br /> when due. <br /> <br /> 4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City Council." <br /> <br />99-111 (c): <br /> <br />"A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING USE PERMIT <br />(GHP-99-01) TO PERMIT SIX CONDOMINIUM RESIDENTIAL UNITS ON SANDIE POINT <br />LANE. <br /> <br /> WHEREAS, the applicant, James R. Bradford, agent for the owner of the subject <br />property, James Grey, has made application pursuant to Section 40-112 of the Code of <br />the City of Portsmouth, Virginia (1988), as amended, for the approval and granting of a <br />group housing permit for six condominium residential units on Sandie Point Lane, <br />Portsmouth, Virginia, more particularly described as follows: <br /> <br /> <br />
