<br />At a regular meeting of the City Council held on September 14, 1976, there were present:

<br /> Rev. W. F. Hendericks, Pastor, Trinity Episcopal Church, opened the meeting with prayer,
<br />followed by the Pledge of Allegiance to the Flag.
<br />
<br /> 76-365 - Public Hearing - Special called meeting of City Council and City Planning
<br />Commission on the following Use Permit Application:

<br /> With the majority of the Planning Commission present, thc petition was approved by
<br />unanimous vote.
<br />
<br />Vice Mayor Wentz chaired this item.
<br />
<br /> Motion of Mr. Barnes and seconded by Mr. Early, to concur in the recommendation of the
<br />Planning Commission and the City Attorney be instructed to insert the proper title for the
<br />petitioner, the following resolution was adopted, and by the following vote:
<br />
<br /> "A RESOLUTION GRANTING A USE PERMIT FOR OPERATING A PRIVATE SCHOOL ON THE
<br /> SOUTH SIDE OF PORTSMOUTH BOULEVARD BET~EN LANSING AVENUE AND FREDERICK
<br /> BOULEVARD; SUSPENDING SECTION 2-17(b) OF THE CITY CODE. (UP-76-9).
<br />
<br /> WHEREAS, Foundation Boy's Academy, Inc. has made an application pursuant to Section 40-75~
<br />of the Code of the City of Portsmouth, Virginia, 1973, for the granting of a use permit as her~
<br />inafter described; and
<br />
<br /> WHEREAS, the applicant and the Planning Director have done all things required to be done
<br />in connection with said application, and the Planning Commission has recommended the granting
<br />of said use permit.
<br />
<br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia:
<br />
<br /> A. That the use for which the use permit hereinafter described is sought: (1) Will not
<br />adversely affect the health or safety of persons residing or working in the neighborhood of the
<br />proposed use; (2) Will not be detrimental to the public welfare or injurious to property and
<br />improvements to the neighborhood; and (5) Will be in accord with the purposes of the Zoning
<br />Chapter of the City Code.
<br />
<br /> B. The City of Portsmouth is hereby granting a use permit pursuant to Section 40-75(b)
<br />of the City Code to operate a private school on property described as follows:
<br />
<br /> Beginning at a point which is approximately 120 feet southwest from the
<br />southwest corner of Portsmouth Boulevard and Lansing Avenue; thence southerly
<br />approximately 80 feet; thence south approximately 280 feet; thence east approxi-
<br />mately 10 feet; thence south approximately 105 feet; thence east approximately
<br />22 feet; thence south approximately 425 feet; thence east~approximately 125
<br />feet; thence south approximately 235 feet; thence southwest approximately
<br />110 feet; thence northwest approximately 815 feet; thence southwest approximately
<br />3OO feet; thence northwest approximately 1OOS feet; thence northerly approximately
<br />175 feet to the south right-of-way line of Portsmouth Boulevard; thence northeas-
<br />terly along said right-of-way approximately 1,760 feet to the Point Of Beginning.

<br /> C. For the purpose of this resolution only, Section 2-17(b) of the City Code is suspended
<br />and this resolution shall be adopted after one vote of the City Council.
<br />
<br />D. This resolution shall take effect immediately after its adoption."

<br /> "A RESOLUTION OPPOSING THE DISESTABLISHMENT OF T}~ MARINE BARRACKS, PORTSMOUTH,
<br /> VIRGINIA.
<br />
<br /> WHEREAS, the Chief of Naval Operations has directed that the Marine Barracks in Poytsmoutt
<br />be consolidated with the Marine Barracks in Norfolk effective September 30, 1976; and
<br />
<br /> WHEREAS, the Marine Barracks in Portsmouth, Virginia, has a long and distinguished
<br />history as the second oldest barracks in continuous service to the Marine Corps; and~
