<br />of the City of Portsmouth as provided by law the sum hereinafter stated to compensate the
<br />owners of the parcel of land designated on that certain plat entitled, "Plat Showing To Be
<br />Acquired From Done E. Smith and Norma J. Smith", a copy of said plat is attached hereto.

<br /> On motion of Mr. Wentz and seconded by Mr. Elliott, the following resolution was adapted
<br />and by the following vote:
<br />
<br /> '4 RESOLUTION TO PROVIDE FOR THE ACQUISITION OF CERTAIN PROPERTY BY THE CITY
<br /> OF PORTSMOUTH, VIRGINIA, UNDER EMINENT DOMAIN PROCEEDINGS PURSUANT TO CHAPTER
<br /> 471 OF THE ACTS OF ASSEMBLY, AS AMENDED, SAID PROPERTY BEING NECESSARY FOR
<br /> THE CONSTRUCTION, ALTERATION AND MAINTENANCE OF PARADISE CREEK DRAINAGE PROJECT.
<br />
<br /> WHEREAS, the City of Portsmouth has found it necessary to acquire interests hereinafter
<br />specified in and to the hereinafter described parcel of Iand situate in the City of Portsmoutt
<br />Virginia, for the purpose of constructing, altering and maintaining the Paradise Creek Drain-
<br />age Project; and
<br />
<br /> WHEREAS, the City of Portsmouth has not been able to purchase property describe~ herein,
<br />necessary to the project, because the owners thereof in the City have not been able to agree
<br />upon price to be paid therefor; and
<br />
<br /> WHEREAS, advancement of the work and use of the said p~oject will be delayed uni~asonabl'
<br />if said property is not made available as soon as possible.
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia:
<br />
<br /> .1. The City Attorney is directed to institute eminent domain proceedings against the
<br />following property situated in the City of Portsmouth, for the purpose of acquiring fee simpl
<br />title therein, together with any and all easements of access, light or air incident to the
<br />lands of the landowner abutting upon said property, in accordance and pursuant to Sections
<br />2.06, 2.07 and 2.08 of the Charter of the City of Portsmouth (Chapter 471 of the Acts of
<br />Assembly of 1970~ as amended), and to deposit to the credit of the Clerk of the Circuit Court
<br />of the City of Portsmouth as provided by law the sum hereinafter stated to compensate the
<br />owners of the parcel of land designated.on that certain plat entitled, "Plat Shawing Property
<br />To Be Acquired From .Clyde W. Beasley and Cornelia R. Beasley", a copy of said plat is attached

<br />thereof in the City have not been able to agree
<br />
<br /> WHEREAS, advancement of the work and use of the said project will be delayed unreasonabl
<br />if said property is not made available as soon as possible.,

<br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia:
