December 14, 1976 <br /> <br /> At a regular meeting of the ~City Council, held on December 14, 1976, there were present: <br /> <br />J~k .~. Barnes, E. Saunders Early, Jr., ArChie Elliott, Jr., James W. Holley, <br />'~d~a~d L. Oast, Jr,, Robert W. Wentz, Jr., R. T. Williams, City Manager, <br />Gordon B. Tayloe, Jr., City Attorney. <br /> <br /> Absent: Richard J. Davis <br /> <br /> Vice Mayor Wentz presided in ~he absence of Mayor Davis and welcomed all Visitors in <br />attendance. <br /> <br /> The City Clerk offered prayer, followed by the Pledge of Alleg{ance to the Flag. <br /> <br /> Motion of Mr. Oast and seconed by Mr. Elliott, minutes of the called meeting of Novemher <br />23, 1976; minutes of the regular meeting of November 23~ 1976; minutes of the Public Hearing <br />meeting of December 6, 1976, to be approved as received, was adopted by unanimous vote. <br /> <br /> 76-S13 - The City M~nager presented Certificate of Appreciation to James C. Greiner, <br />Director of Parks & Recreation, in recognition of receiving the "Virginia Recreation and Pa~ks <br />Society Fellows Award for 1976". Vice Mayor Wentz congratulated Mr. Greiner on behalf of thel <br />City Council for this outstanding award. <br /> <br />- UNFINISHED BUSINESS <br /> <br /> 76-510 - The following ordinance approved on first reading at the Public Hearing meeting <br />of December 6, 1976, was taken up and read: <br /> <br />(a) "ZONING AMENDMENT ORDINANCE Z 76-23" <br /> <br /> On mo~i~n of Mr. Holley and seconded b~Mr. Elliott, the ordinance was adopted, and by <br />the fo%i0~ing vote: <br /> <br />Ayes: Barnes, Early, Elliott, Holley, Oast, Wentz <br />Nays: None <br /> <br /> Motion of Mr. Barnes and seconded by Mr. Holley, to reconsider the approval of the <br />minutes of December 6, 19-76, was adopted by unanimous vote. <br /> <br /> Motion of Mr. Barnes and seconded by Mr. Holley, to delete the words "Zoning'~anendmen't <br />Ordinance Z 76-23" as to the area suggested by the City Manager as shown in the minutes of <br />December 6. <br /> <br /> Substitute motion of Mr. Barnes and seconded by Mr. Holley to leave "Zoning Amendment <br />Ordinance Z 76-23", petition of Alford L. Marable, Owner, as recorded. Proposed Z'on'ing Am'end- <br />ment by the City Manager "that the area Northeast of the Western Freeway--~e~e to <br />La~ Kingman be zoned industrial and be referred to the Planning Commission" for their con- <br />sideration, was adopted by unanimous vote. <br /> <br /> Motion of Mr. Holley and seconded by Mr. Elliott, the minutes to be approved as corrected <br />was adopted by unanimous vote. <br /> <br /> 76-510 - The following ordinance approved on first reading at the Public Hearing meeting <br />of December 6, 1976, was taken up and read: <br /> <br />(e) "AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, <br /> BY ADDING THERETO SECTION 33-S?, PERTAINING TO CERTAIN MINOR SUBDIVISIONS." <br /> <br /> On motion of Mr. Elliott and seconded by Mr. Holley, the ordinance was adopted, and by- <br />the following vote: <br /> <br />AYes: Barnes, Early, Elliott, Holley, Oast, Wentz <br />Nays: None <br /> <br />76-495 - Proposed Charter Amendment, defer?ed from meeting of November 23, 1976. <br /> <br />City Manager presented the following recommmendations: <br /> <br /> "In reference to the proposed Charter changes which were subject to public hearing <br />at our last Council meeting, I would like to make the following recommendations: <br /> <br />(A) That the position of High Constable remain in the City Charter as a position <br /> to be appointed by the City Council. <br /> <br />(B) <br /> <br />%his position is very interrelated with the courts ~nd justice systems. <br />~herefore, I feel it very apppopriate for this position to continue as an <br />appointed position by the City Council. However, I do feel that language <br />related to financial operations 'of the office should be included outlining <br />the responsibilities of the office, accounting procedures to be utilized, <br />as well as reports on a periodic basis. <br /> <br />That the position of Delinquent Tax Collector be deleted from the Charter <br />as an appointed position by the City Council. The deletion of this specific <br />language from the Charter will make this position subject to appointment <br />by the City Manager. <br /> <br /> <br />
