166 <br /> <br />April 12, 1977 <br /> <br /> On motion of Mr. Early a~d seconded by Mr. Holley, the following resolution was adopted, <br />and by the following vote: <br /> <br />"A RESOLUTION TO PROVIDE FOR THE ACQUISITION OF CERTAIN PROPERTY BY THE CITY <br />OF PORTSMOUTH, VIRGINIA, UNDER EMINENT DOMAIN PROCEEDINGS PURSUANT TO CHAPTER 471 <br />OF THE ACTS OF ASSEMBLY, AS AMENDED, SAID PROPERTY BEING NECESSARY FOR THE CON- <br />STRUCTION, ALTERATION AND MAINTENANCE OF THE CRADOCK STREET IF~ROVEMENT PROJECT. <br /> <br /> WHEREAS, the City of Portsmouth has found it necessary to acquire interests hereinafter <br />specified in and to the hereinafter described parcel of land situate in the City of Portsmoutk <br />Virginia, for the purpose of constructing, altering and maintaining the Cradock Street Improve <br />ment Project. <br /> <br /> WHEREAS, the City of Portsmouth has not been able to purchase property described herein, <br />necessary to the project, because the owners thereof in the City have not been able to agree <br />upon a price to be paid therefor; and <br /> <br /> WHEREAS, advancement of the work and use of the said project will be delayed unreasonabl~ <br />if said property is not made available as soon as possible. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsm~utbf~Virg~Ri~: <br /> <br /> 1. The City Attorney is directed to institute eminent domain proceedings against the <br />following property situated in the City of Portsmouth, for the purpose of acquiring fee simple <br />title therein, together with any and all easements of access, light or air incident to the lants <br />of the landowner abutting upon said property, in accordance and pursuant to Sections 2.06, <br />2.07 and 2.08 of the Charter of the City of Portsmouth (Chapter 471 of the Acts of Assembly of <br />1970, as amended), and to deposit to the credit of the Clerk of the Circuit Court of the City <br />of Portsmouth as provided by law the sum hereinafter stated to compensate to the owners of thei <br /> parcel of land designated on the plat entitled, "Plat Showing Drainage Easement To Be Conveye~ <br />To City Of Portsmouth By Nancy C. Kennedy", a copy of said plat is attached hereto. <br /> <br /> 2. The name of the property owner is: Nancy C. Kennedy. The amount to be paid is: <br />$25.00." <br /> <br /> Ayes: <br /> Nays: <br />Abstaining: <br /> <br />Early, Elliott,Holley, Wentz <br />None <br />east <br /> <br />NEW BUSINESS - <br /> <br />77-119 - The following letter from the Municipal Finance Commission was presented: <br /> <br /> At ~the regularly scheduled meeting of the Municipal Finance Commission held March 15, <br />1977, the Commission reviewed revenue estimates for the 1977-78 operating budget. Although <br />the revenue estimates, as presented by the City Manager and Director of Finance, are still <br />preliminary estimates at this point in time, it is apparent that only a small increase in <br />growth revenues can~ reasonably be anticipated for th'e next fiscal year--approximately three <br />percent. <br /> <br /> Even at this early stage in the budgeting process, it is obvious to this Commission that <br />growth revenues alone will not provide for the continuation for another fiscal year of the <br />current level of municipal sevices. In order to provide for a balanced budget, it will be <br />necessary fo resort to one or more of the following alternatives: <br /> <br />1) Cut services; <br />2) Provide no salary increase for employees; <br />$) Greater utilization of Revenue Sharing funds in <br /> the operating budget; <br />4) Increased utilization of the unappropriated fund <br /> balance; <br />S) Increase taxes. <br /> <br /> Whereas it is not possible at t~is early date to recommend which of these alternatives <br />should ben, and to what extent, this Commission will provide you with a specific recom- <br />mended mix of alteratives concurrent with our budget reCommendations~ <br /> <br /> In addi%ion, the Commission decided to reassess its recommendation of several years <br />standing that approximately thirty-five percent of local revenues be allocated to educational <br />purposes. The 1976-77 budget allocated forty percent and the proposed 1977-78 school budget <br />would require an even greater percentage of local revenues. Either substantial reductions to <br />allocated'to s~hool purposes will have to be increased to a level substantially above the <br />previously redommended level of thirty-five percent. O~r recommendation in this regard will <br />also be furnished with our budget recommendation. <br /> <br /> The Commission acted unanimously to forward the foregoing funding analysis to the Ports- <br />mouth City Council." <br /> <br /> Motion of Mr. Elliott and seconded by Mr. east, to be received as information, and was <br />adopted by unanimous vote. ~ <br /> <br /> 77-120 - On motion of Mr. Elliott and seconded by Mr. Holley, the following resolution <br />was adopted, and by the following vote: <br /> <br /> <br />
