<br /> 77-421 "Consideration of a rssolution appointing viewers for the closing of a portion
<br />of Partridge Street and a portion of Reid Street~

<br /> The City of Portsmouth has made application to close a portion of Partridge Street and
<br />a portion of Reid Street. Pursuant to State law this resolution appoints viewers to make a
<br />recommendation to the City Cuuncil. The City Manager recommends adoption."
<br />
<br /> On motion of Mr. Holley and seconded by Mr. Elliott, the following resolution was
<br />adopted, and by the following vote:
<br />
<br />"A RESOLUTION APPOINTING VIEWERS FOR CLOSING THE FOLLOWING STREETS: PARCEL I,
<br />A PORTION OF PARTRIDGE STREET AND pARCEL II, A PORTION OF REID STREET.
<br />
<br /> WHEREAS, the City of PortSmouth has made application to vacate, close and discontinue
<br />Parcels I and II, the hereinafter described portions of certain streets, and it appear-
<br />ing that Notice of Application and request for the appointment of viewers was duly posted
<br />October 20, 1977 on the bulletin board of the City Hall Building of the City of Portsmouth,
<br />the bulletin board of the General District Court, Civil Division, of the City of Portsmouth
<br />and the bulletin board of the Circuit Court of the City of Portsmouth.
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia,
<br />that Frank N. Bilisoly, Simond P. Arrington, H. L. Davis, Belvin Blachman, Zalmon Blachman
<br />be appointed viewers and Louis J. Leitner be appointed the alternate viewer in the event
<br />one of the preceding viewers fails to participate, said viewers to view the hereinafter
<br />described portions of such streets and to report to the Council in writing whether in
<br />their opinion any, and if any, what inconvenience would result in vacating and closing
<br />the following:

<br />
<br /> All that certain piece or parcel of land, lying and being in the City of
<br />Rortsmouth, Virginia, and comprising that portion of Partridge Street lying
<br />between the east right-of-way of Nicholson Street amd t~e east right-of-way
<br />l~ine o.f Reid Street (S-77-27).

<br />Parcel II - Reid Street
<br />
<br /> All that certain piece or parcel of land, lying and being in the City of
<br />Portsmouth, Virginia, and comprising that portion of Reid Street beginning
<br />at the northwest corner of Reid and Partridge Streets; thence north along
<br />the west right-of-way line of Reid Street 30'; thence East 40' to the east
<br />right-of-way line of Reid Street; thence south along said right-of-way 30'
<br />tO:the north right-of-way line of Partridge Street; thence west 40' to the
<br />point of origin (S-77-28)."

<br /> 77-422 - "Consideration of a motion authorizing the Commissioner of Revenue to rebate
<br />and the City Treasurer to ~efund personal property taxes with interest to Mr. ~ames ~. Houck
<br />in the amount of $724.40 for the year 1975 and 1976.
<br />
<br /> This refund is being requested wi%hin the 3 years Statute of Limitations as provided by
<br />the Code of Virginia. The taxes are being refunded on a truck owned and operated by Mr. Houc]
<br />and licensed and taxed pursuant to megulations of the Interstate Commerce Commission and the
<br />State Corporation Commission. Under State law no local property taxes shall be levied or im-
<br />posed on roll~ing stock certificates issued by the Interstate Commerce Commission; therefore,
<br />an erroneous assessment was made and taxes should be refunded. The City Manager recommends
<br />adoption."

<br /> Motion of Mr. Barnes and seconded by Mr. Holley, that authorization be granted to refund
<br />$724.40, with interest, to James F. Houck for personal property taxes for the years of 1975
<br />and 1976, was adopted by unanimous vote.

<br />
<br /> 77-423 - Mr. John F. Bailey, Jr., 203 Dixie Avenue, spoke regarding trash not being
<br />picked up when requested on his pick-up day (Wednesday), after a second request and t~at
<br />better service be afforded for fee charged fhr this service. (See Exhibit 77-423)
<br />No action ~aken.

<br /> 77-424 - Mr. Robert C. Caldwell, 324 Louisa Ave$ue, virginia Beach, represent~.! !?
<br />Tidewater Association for Retarded Citizens, spoke on Item 77-414, approval of the ordinance
<br />and what it meant to the children affecte~ by the lead poisoning.
<br />
<br /> 77-425 - City Manager presented a report on hiring practice' within city departments
<br />as requested by Mayor Davis. (See.Exhibit 77-425). No action taken.
<br />
<br /> 77-426 - Motion of Mr. Wentz and seconded by Mr. Early, to go into the election of
<br />members to Boards and Commissions, was adoptedbby unanimous vote.
