3.8'2 <br /> <br />March 14, 1978 <br /> <br />issue shall be payable not exceeding Forty (40) years from its date, and said bonds shall <br />bear interest at a rate or rates to be hereinafter determined by the Council upon the sale <br />of said bonds, providing that the maximum rate of interest shall not exceed the maximum rate <br />of interest authorized by law at the time of the sale of said bonds. <br /> <br /> 4. SimultaneoUsly~ith retirement of said notes of the Authority the payment of a portion <br />of which is hereby guaranteed, or provision having been made for the retirement of said notes, <br />this resolution shall terminate and be of no effect. <br /> <br /> 5. The provisions of this resolution shall become effective when the cities of Franklin, <br />Norfolk, Portsmouth, Suffolk and Virginia Beach have incurred contract obligations t° provide <br />payments to the Authority in the amounts of $25,000, $837,000, $526,000, $140,0OO and $605,0OO~ <br />respectively. <br /> <br /> 6. This resolution shall take effect from the date of its adoption." <br /> <br /> Ayes: Barnes, Early, Elliott, Holley, Oast, Wentz, Davis <br /> Nays: None <br /> <br /> 78-91 "Consideration of a repolution~expressing the consent of the Council to the vaca- <br />tion of a drainage easement in the subdivision of Hodges Manor. <br /> <br /> This resolution will vacate ~ drainage easement that is no longer needed by the City, <br />and has been declared surplus property. The drainage easement was recorded in the Clerk's <br />Office of the Circuit~Court, as Hodges Manor, Section 4, behind lots 10 through 12; and, was <br />dedicated by the developer for that purpose. The easement, is no longer required by the City. <br />The City Manager recommends adoption." <br /> <br /> On motion of Mr. Elliott and seconded by Mr. Oast, the following resolution was adopted, <br />and by the following vote: <br /> <br /> "A RESOLUTION EXPRESSING THE CONSBNT OF THE COUNCIL TO THE VACATION OF A DRAINAGE <br /> EASEMENT IN THE SUBDIVISION OF HODGES MANOR, SECTION 4, LOTS 10, 1t AND 12. <br /> <br /> WHEREAS, by plat recorded in the Clerk's Office of the Circuit Court of the City of <br />Chesapeake, Virginia, in Map Book'40, Page 106, entitled: "Hodges Manor, Section 4", an <br />easement for drainage along the rear lot lines of lots 10, 11 and 12 was dedicated by the <br />developer for the purpose of street drainage from Portsmouth Boulevard; and <br /> <br /> WHEREAS, said drainage easement is no longer required by the City of Portsmouth, and <br />is hereby declared to be excess property. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that <br />the Council hereby expressps its consent to the vacation of the drainage easement across <br />the rear lot lines of lots 10, 11 and 12 on that certain plat entitled: '~Hodges Manor, Sectiol <br />4", recorded in the Clerk's Office of the Circuit Court of the City of Chesapeake, Virginia, <br />said easement being more particularly described by plat entitled: "Plat Showing Conflict <br />Between City Of Portsmouth Property (Parcels A,B,~C) And Lots 10, 11, And 12, Hodges Manor <br />Section 4", dated December 30, 1977, prepared by the Engineering and Technical Services Depart+ <br />ment of the City of Portsmouth, Virginia, attached hereto. <br /> <br /> BE IT FURTHER RESOLVED that the City Manager be, and he hereby is, authorized to execute <br />all documents and complete all transactions incident to the vacation of this easement." <br /> <br />Ayes: Barnes, Early, Elliott, Holley, Oast, Wentz, Davis <br />Nays: None <br /> <br /> 78-92 "Consideration of a <br />to the Crawford Connector as ORT <br />for one day. <br /> <br />resolution designating Court Street from the Crawford Parkway <br />(Organization for Rehabilitation through Training) Street ~ <br /> <br /> This resolution will be a one day tribute to ORT by designating a City street to ORT <br />Str~ez for one day (24 hours). The week of March 20th, 1978, has been designated as ORT <br />}~eek and has been so proclaimed by the Mayor. The City Manager recommends adoption." <br /> <br /> On motion of Mr. Barnes and seconded by Mr. Elliott, the following resolution was adopted <br />and by the following vote: <br /> <br /> "A RESOLUTION DESIGNATING COURT STREET FROM CRAWFORD PARKWAY TO THE CRAWFORD <br /> CONNECTOR AS ORT STREET FOR THE 22nd DAY OF MARCH, 1~8, IN HONOR OF ORT WEEK. <br /> WHEREAS, ORT (Organization for Rehabilitation through Training) has dedicated itself <br />to the creation of a dynami~ world-wide network of some 700 Vocational, Education and Training <br />Schools, spanning five continents; and <br /> WHEREAS, the Honorable Richard J. Davis, Mayor of the City of Portsmouth, has proclaimed <br />the week of March 19 through March 25, 1978 as ORT week in Portsmouth. <br /> NOW, THEREFORE, BE IT RESOLVED that the Council of the City o{ Portsmouth, Virginia, <br />in further recognition of the vital achievements of Womens American ORT, hereby designates <br />Court Street from Crawford Parkway to the Crawford Connector as ORT Street for the 22nd day <br />of March, 1978." <br /> <br /> Ayes: Barnes, Early, Elliott, Holley, Oast, Wentz, Davis <br /> Nays: None <br /> <br /> <br />
