(d) "A RESOLUTION GRANTING A USE PER>IIT TO HAROLD L, AND SHIRLEY J. RYNDERS TO OPERATE A CONVALESCENT HOME ON HARROWER COURT. WHEREAS, Harold L. and Shirley J. Rynders, pursuant to 40-?S(b) of the Code of the City of Portsmouth, Virginia, 197S, have applied for the granting of a use permit as hereinafter described; and WHEREAS, the applicant and Planning Director have done all things required to be done in connection with said application; and :~ WHEREAS, the Planning Commission has recommended that the granting of said use permit. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: (1) That the-use for which the use permit hereinafter is sought: (a) Will~ono~w-adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use; (b) Wiii._not be detrimental to the public use or injurious to the property or improvements in the neighborhood; and (c) Will be in accordance with the purposes of the Zoning Chapter of the City Code. (2) Harold L. and Shirley J. Rynders are hereby granted a use permit pursuant to Section 40-75(b) of the City Code to operate a convalescent home on the property described as follows Beginning on the east side of Harrower Court, approximately 750' south from its intersection with Johnson Avenue; thence easterly 1OO' to a point; thence southerly 218.20'; thence northwesterly approximately 220' to the east right of way of Harrower Court; thence northerly along said right of way approximately 60' to the point of origin. (S) The issuance of such use permit is subject to the following conditions: · (a) The staff parking of the convalescent home shall not be fewer than five (S) spaces and be behind the building and served by the access driveway of Harrower Court to the dwelling's service entrance. (b) The City Code standards should be applied in terms of minimum bedroom floor area and occupancy. (c) Tka-t'& p.~oper planting screen should be occupants of property to the rear. ,i (d) That State certification in the form of provided to insure privacy for license will be maintained." WHEREAS, West Park Church of Christ, pursuant to Section 40-75(b) of the Code of the City of Portsmouth, Virginia, 1973, has applied for the granting of a use permit as hereinafl described; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of said use permit.
