(d) "A RESOLUTION GRANTING A USE PER>IIT TO HAROLD L, AND SHIRLEY J. RYNDERS TO <br /> OPERATE A CONVALESCENT HOME ON HARROWER COURT. <br /> <br /> WHEREAS, Harold L. and Shirley J. Rynders, pursuant to 40-?S(b) of the Code of the City <br />of Portsmouth, Virginia, 197S, have applied for the granting of a use permit as hereinafter <br />described; and <br /> <br /> WHEREAS, the applicant and Planning Director have done all things required to be done <br />in connection with said application; and :~ <br /> <br />WHEREAS, the Planning Commission has recommended that the granting of said use permit. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: <br /> <br />(1) That the-use for which the use permit hereinafter is sought: <br /> <br /> (a) Will~ono~w-adversely affect the health and safety of persons residing or <br />working in the neighborhood of the proposed use; <br /> <br /> (b) Wiii._not be detrimental to the public use or injurious to the property <br />or improvements in the neighborhood; and <br /> <br /> (c) Will be in accordance with the purposes of the Zoning Chapter of the <br />City Code. <br /> <br /> (2) Harold L. and Shirley J. Rynders are hereby granted a use permit pursuant to Section <br />40-75(b) of the City Code to operate a convalescent home on the property described as follows <br /> <br /> Beginning on the east side of Harrower Court, approximately 750' <br />south from its intersection with Johnson Avenue; thence easterly 1OO' <br />to a point; thence southerly 218.20'; thence northwesterly approximately <br />220' to the east right of way of Harrower Court; thence northerly along said <br />right of way approximately 60' to the point of origin. <br /> <br />(S) The issuance of such use permit is subject to the following conditions: <br /> <br /> · (a) The staff parking of the convalescent home shall not be fewer than five (S) <br />spaces and be behind the building and served by the access driveway of Harrower Court to the <br />dwelling's service entrance. <br /> <br /> (b) The City Code standards should be applied in terms of minimum bedroom floor <br />area and occupancy. <br /> <br /> (c) Tka-t'& p.~oper planting screen should be <br />occupants of property to the rear. <br />,i <br /> (d) That State certification in the form of <br /> <br />provided to insure privacy for <br />license will be maintained." <br /> <br />Ayes: Barnes, Early, Elliott, Gray, Holley, Oast <br />Nays: None <br /> <br /> 78-262 - On motion of Mr. Barnes and seconded by Mr. Elliott, <br />approved on first reading at the Public Hearing Df August 7, 1978, <br />following vote: <br /> <br />the following resolution <br />was ad~pted and by the <br /> <br />(e) "A RESOLUTION GRANTING A USE PER>lIT TO WEST PARK CHURCH OF CHRIST TO OPERATE <br /> A DAY CARE CENTER ON CHARITY ROAD. <br /> <br /> WHEREAS, West Park Church of Christ, pursuant to Section 40-75(b) of the Code of the <br /> City of Portsmouth, Virginia, 1973, has applied for the granting of a use permit as hereinafl <br />described; and <br /> <br /> WHEREAS, the applicant and the Planning Director have done all things required to be <br />done in connection with said application; and <br /> <br />WHEREAS, the Planning Commission has recommended the granting of said use permit. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: <br /> <br /> (1) That the use for which the use permit hereinafter is sought: <br /> <br /> (a) Will not adversely affect the health and safety of persons residing or working <br />in the neighborhood of the proposed use; and <br /> <br /> (b) Will not be detrimental to the public use or injurious to the property or <br />improvements in the neighborhood; and <br /> <br /> (c) Will be in accord with the purposes of the Zoning Chapter of the City Code. <br /> <br /> (2) West Park Church of Christ is hereby granted a use permit pursuant to Section <br />40-75(b) of the Code of the City of Portsmouth, Virginia, 1973, to operate a day care center <br />on the property described as follows: <br /> <br />er <br /> <br /> <br />
