AN ORDINANCE TO A/~END THE CODE OF THE CITY OF PORTSMOUTH, <br />VIRGINIA, 1973, BY AMENDING SECTION 40-137(k), (5), AND (6), <br />PERTAINING TO ZERO LOT LINE~ <br /> <br /> BE IT~ORDAINED by the Councit~of thelCity 'of Portsmouth, <br />Virginia, that Sections 40-i37(k)~ (5) and (6) of the Code <br />of the City of Portsmouth, Virglnla~ 1973~ as amended~ be <br />amended to read as follows: <br /> <br /> (5) At least a five (5) foot nonexclusive maintenance <br />easement contiguous to the zero lot line wall on the adjoin- <br />ing property is reserved for the homeowner to repair and <br />maintain said wall; provided, in R-75-S Districts the <br />Planning Commission may waive this requirement in the case <br />of dwellings in the form of two attached single f~mily <br />dwellings where each single family dwelling lot contains the <br />minimum area prescribed for this zoning district. <br /> <br /> (6) A one (t) foot ~ava encroachment is permitted <br />across the line into the adjoining lot; provided in R-75-S <br />Districts the Planning Commission may waive such requirement <br />in the case of dwellings in the form of two attached singl~ <br />family dwellings or where each single family dwelling lot <br />contains the minimum area prescribed for %his zoning district. <br /> <br /> Adopted by the Council of the City of Portsmouth, <br />Virginia~ at a meeting held January 9~ 1979. <br /> <br /> Teste: <br /> <br />City Clerk <br /> <br /> <br />
