ORDINANCE NO. 2026-22 <br />AN ORDINANCE AUTHORIZING PAYMENT OF ESCHEATED FUNDS FROM THE <br />TAX SALE OF 3506 BLAINE STREET TO DAVID V. GILL AND DANIEL LEE <br />BARNS AS AUTHORIZED BY SECTION 58.1-3967 OF THE VIRGINIA CODE AND <br />APPROPRIATING THE SUM OF $9,525.24 FROM THE FUND BALANCE OF THE <br />GENERAL FUND TO THE FY 2026 GENERAL FUND BUDGET FOR SAID <br />PURPOSE. <br />WHEREAS, the property located at 3506 Blane Street, Portsmouth, Virginia (the <br />"Property"), was sold at a tax sale and, pursuant to Section 58.1-3967 of the Virginia Code, the <br />surplus funds of that tax sale escheated to the city; and <br />WHEREAS, Section 58.1-3967 of the Virginia Code provides that, after a city receives <br />escheated funds from a tax sale, the former owner or their heirs and assigns may petition City <br />Council to recover the escheated funds, and Council may, in its sole discretion, grant or deny the <br />petition; and <br />WHEREAS, David V. Gill and Daniel Lee Barns, pursuant to Section 58.1-3967 of the <br />Virginia Code, have, by counsel, submitted a request to City Council for payment of their shares <br />of the escheated funds from the sale of the Property; and <br />NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br />1. That it grants relief by authorizing the following payments, based on each <br />individual's interest in the Property: <br />$4,762.62 to David V. Gill <br />$4,762.62 to Daniel Lee Barns. <br />2. That the sum of $9,525.24 is appropriated from the Fund Balance of the General <br />Fund to the FY 2026 General Fund Budget for said purpose. <br />3. That estimated revenues and expenditures in the FY 2026 General Fund Budget <br />are increased by $9,525.24. <br />4. That this ordinance shall take effect immediately upon adoption. <br />ADOPTED by the Council of the City of Portsmouth, Virginia, at a meeting held on April <br />14, 2026. <br />Teste: <br />City Clerk <br />
