(Tax Parcel 0024-1280) <br />ALL THAT certain lot, piece or parcel of land, with the buildings and <br />improvements thereon, situate, lying and being in the City of <br />Portsmouth, Virginia, and known, numbered and designated as Parcel C <br />& D, as shown on that certain plat entitled "Replat Plan of H.L. <br />Alexanders property, Portsmouth, Virginia," which said plat is duly <br />recorded in the Clerk's Office of the Circuit Court of the City of <br />Portsmouth, Virginia in Map Book 1, page 31. <br />IT BEING that certain property conveyed to PTJ, LLC by Deed of <br />Bargain and Sale from Historic Ventures, L.L.C., a Virginia limited <br />liability company, dated February 7, 2005 and recorded in the Clerk's <br />Office of the Circuit Court for the City of Portsmouth, Virginia as <br />Instrument Number 050003534. <br />6. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br />(a) The warehouse use shall be limited to the storage of manufactured products, <br />supplies, and equipment, excluding bulk storage of materials that are <br />flammable or explosive or that present hazards or conditions commonly <br />recognized as offensive. <br />(b) The exterior of the structure shall be maintained in good condition, with all <br />surfaces not proposed for public art protected from the elements by <br />repainting or other protective treatment. <br />(c) No materials shall be stored or deposited on the premises in such form or <br />manner that they may be transferred off the premises by natural causes or <br />forces. <br />(d) The proposed use shall be operated in compliance with all applicable codes, <br />ordinances, and regulations of federal, state, and local government, and all <br />required licenses and permits shall be obtained and remain in effect during <br />the operation of the development. <br />(e) All taxes/fees associated with the property shall be paid when due, as <br />determined by the City Treasurer. <br />(f) This Use Permit shall automatically expire and become void two (2) years <br />from the date of approval by City Council if the use is inactive or changed <br />to a different use, unless within such two-year period: (i) a building permit <br />is obtained, and erection or alteration of a structure is started; or (ii) a <br />certificate of occupancy is obtained, and the approved use is commenced. <br />
