(Tax Parcel 0024-1280) ALL THAT certain lot, piece or parcel of land, with the buildings and improvements thereon, situate, lying and being in the City of Portsmouth, Virginia, and known, numbered and designated as Parcel C & D, as shown on that certain plat entitled "Replat Plan of H.L. Alexanders property, Portsmouth, Virginia," which said plat is duly recorded in the Clerk's Office of the Circuit Court of the City of Portsmouth, Virginia in Map Book 1, page 31. IT BEING that certain property conveyed to PTJ, LLC by Deed of Bargain and Sale from Historic Ventures, L.L.C., a Virginia limited liability company, dated February 7, 2005 and recorded in the Clerk's Office of the Circuit Court for the City of Portsmouth, Virginia as Instrument Number 050003534. 6. That the use permit is approved subject to the following conditions which shall be observed by the applicant and any successor in interest: (a) The warehouse use shall be limited to the storage of manufactured products, supplies, and equipment, excluding bulk storage of materials that are flammable or explosive or that present hazards or conditions commonly recognized as offensive. (b) The exterior of the structure shall be maintained in good condition, with all surfaces not proposed for public art protected from the elements by repainting or other protective treatment. (c) No materials shall be stored or deposited on the premises in such form or manner that they may be transferred off the premises by natural causes or forces. (d) The proposed use shall be operated in compliance with all applicable codes, ordinances, and regulations of federal, state, and local government, and all required licenses and permits shall be obtained and remain in effect during the operation of the development. (e) All taxes/fees associated with the property shall be paid when due, as determined by the City Treasurer. (f) This Use Permit shall automatically expire and become void two (2) years from the date of approval by City Council if the use is inactive or changed to a different use, unless within such two-year period: (i) a building permit is obtained, and erection or alteration of a structure is started; or (ii) a certificate of occupancy is obtained, and the approved use is commenced.
