BEGINNING; thence N 39° 25' 57" E a distance of 307.07 feet to a <br />point; thence S 50° 34' 03" E a distance of 48.63 feet to a point; <br />thence S 48° 25' 57" W a distance of 310.89 feet to the TRUE POINT <br />OF BEGINNING as shown on that certain plat entitled "Plat Showing <br />Property Owned by City of Portsmouth" dated February 14, 1975, <br />prepared by the Department of Engineering City of Portsmouth, <br />Virginia, that is attached to and made a part of that certain Deed of <br />Exchange dated April 8, 1975 that is recorded in the Clerk's Office of <br />the Circuit Court of the City of Portsmouth, Virginia in Deed Book <br />662, at page 38. <br />IT BEING: (1) all that certain property conveyed to New Port Property <br />Investors, L.C. by Special Commissioner's Deed from Jason A. Dunn <br />dated January 31, 2025 and recorded in the Portsmouth Circuit Court <br />Clerk's Office as Instrument Number 202501073; and (2) all that <br />certain property conveyed to New Port Property Investors, L.C. by <br />Quitclaim Deed from Portsmouth Partners of Virginia dated August <br />13, 2025 and recorded in the Portsmouth Circuit Court Clerk's Office <br />as Instrument Number 202509556. <br />6. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br />(a) The development shall be in substantial compliance with the site plan <br />concept entitled "New Port — Phase 2 Conceptual Master Plan" prepared <br />by Land Planning Solutions, dated May 5, 2025, and revised November <br />10, 2025, except where modifications may be required to comply with all <br />applicable local, state, and federal codes and regulations. <br />(b) The development shall be in substantial compliance with the rendered <br />concept elevations entitled "New Port Phase Product Types" prepared by <br />Land Planning Solutions and submitted September 19, 2025, except where <br />modifications may be required to comply with all applicable local, state, <br />and federal codes and regulations. <br />(c) Before initially operating any multi -family dwelling development as <br />apartments (rental units), the owner and/or operator shall install and <br />maintain digital video equipment with recording capabilities sufficient to <br />indicate the date and time that the recording is made. The recording shall <br />provide surveillance coverage encompassing the front, side, and rear <br />exteriors of any rental unit development for 24 hours a day, 7 days a week. <br />Recorded data must be maintained in a condition permitting review of the <br />information for a period of no less than thirty (30) days. <br />(d) The development shall be constructed in compliance with all applicable <br />codes, ordinances, and regulations of federal, state, and local government, <br />
