(c) The development shall in substantial compliance, including with respect to <br />building design and construction materials, with the rendering and concept <br />exterior elevations entitled "Ansell Building 1 — Exterior Elevation <br />Renderings" and "Ansell Building 2 — Exterior Elevation Renderings" <br />prepared by Arnold Design Studio dated December 10, 2025, except where <br />modifications may be required to comply with applicable local, state, and <br />federal codes or regulations. <br />(d) The existing vegetation located in a 10 -foot wide strip along the southern <br />property line abutting existing single-family residences shall be retained to <br />the maximum extent possible. <br />(e) The development shall include not more than 39 multifamily dwelling units <br />with associated facilities and amenities. <br />(f) Prior to issuance of Site Plan approval, a Minor Subdivision plat to vacate <br />the lot lines between 2216 Waldron Avenue and 2220 Waldron Avenue and <br />combine them into a single parcel must be approved by the City and <br />recorded by the property owner. The Plat shall comply with all applicable <br />requirements in Chapter 33.1 (Subdivisions) of the City Code. <br />(g) A Zoning Permit must be obtained from the City Zoning Administrator <br />prior to commencing the use, and a Certificate of Occupancy must be <br />obtained from the City Department of Permits and Inspections prior to the <br />occupancy of a dwelling unit. <br />(h) Prior to obtaining a Certificate of Occupancy and for so long as the <br />multifamily dwelling use continues on the property, the owners and/or <br />operators shall install and maintain digital video equipment with recording <br />capabilities sufficient to indicate the date and time that the recording is <br />made. The recording shall provide surveillance coverage encompassing the <br />front, side, and rear exteriors of all buildings for 24 hours a day, 7 days a <br />week. Recorded data must be maintained in a condition permitting review <br />of the information for a period of no less than thirty days. <br />(i) All taxes/fees associated with the property and/or the proposed use must <br />be paid when due, as determined by the City Treasurer. <br />(j) Without limitation, this Use Permit is subject to Section 40.2-533(K) of the <br />Zoning Ordinance, which provides that this Use Permit may automatically <br />expire and become void if certain conditions set forth therein are not <br />satisfied within two (2) years from the date of approval by City Council. <br />(k) In accordance with Zoning Ordinance Section 40.2-533(L), this Use Permit <br />may be revoked by City Council after conducting a public hearing.
