1.21. Normal Operating Conditions: Shall be defined herein as it is defined <br />under 47 C.F.R. § 76.309(c)(4)(ii), meaning those service conditions which are within the control <br />of the Franchisee. Those conditions which are not within the control of the Franchisee include, <br />but are not limited to, natural disasters, civil disturbances, power outages, telephone network <br />outages, and severe or unusual weather conditions. Those conditions which are ordinarily within <br />the control of the Franchisee include, but are not limited to, special promotions, pay-per-view <br />events, rate increases, regular peak or seasonal demand periods, and maintenance or rebuild of <br />the Cable System. <br />1.22. PEG: Public, Educational, and Governmental. <br />1.23. Person: An individual, partnership, association, joint stock company, <br />trust, corporation, or limited liability entity. <br />1.24. Public Rights -of -Way: Shall mean the surface of, and the space above and <br />below, any public street, lane, alley, sidewalk, or other public right-of-way, including, but not <br />limited to, public utility easements, dedicated utility strips, or rights-of-way dedicated for <br />compatible uses now or hereafter held by the LFA in the Franchise Area. Notwithstanding the <br />foregoing, Public Rights -of -Way do not include the airwaves above a right-of-way with regard to <br />cellular or other nonwire communications or broadcast services. <br />1.25. Service Area: All portions of the Franchise Area where Cable Service is <br />being offered. <br />1.26. Service Interruption: The loss of picture or sound on one or more cable <br />channels. <br />1.27. Standard Definition, or SD: For the purposes of this Franchise, a display <br />format for digital television transmissions of PEG Channels transmitted in a 4:3 aspect ratio with <br />a resolution of 480p. <br />1.28. Subscriber: A Person or governmental entity who lawfully receives Cable <br />Service over the Cable System with Franchisee's express permission. <br />1.29. Telecommunication Services: Shall be defined herein as it is defined <br />under Section 3 of the Communications Act, 47 U.S.C. § 153(53), meaning the offering of <br />telecommunications for a fee directly to the public, or to such classes of users as to be effectively <br />available directly to the public, regardless of the facilities used. <br />1.30. Telecommunications Facilities: Franchisee's Telecommunications <br />Services, including its Information Services facilities and its FTTP Network facilities. <br />1.31. Telecommunications Franchise: The telecommunications franchise <br />between the LFA and Chesapeake and Potomac Telephone Company of Virginia dated <br />December 11, 1984, as such Telecommunications Franchise currently exists and may be <br />amended, renewed, or superseded by other telecommunications franchises in the future. <br />1.32. Title II: Title 11 of the Communications Act. <br />
