ORDINANCE NO. 2025-100 <br />AN ORDINANCE AMENDING AND REORDAINING CHAPTER 9.1 <br />(CHESAPEAKE BAY PRESERVATION AREA OVERLAY DISTRICT) OF THE <br />CODE OF THE CITY OF PORTSMOUTH, VIRGINIA FOR THE PURPOSE OF <br />MAKING AMENDMENTS REQUIRED BY STATE LAW, INCLUDING <br />IMPLEMENTING CRITERIA FOR RESILIENCY TO BE INCLUDED IN THE <br />PERFORMANCE STANDARDS FOR DEVELOPMENT IN RESOURCE <br />PROTECTION AREAS. <br />BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br />1. That it amends and reordains Chapter 9.1 (Chesapeake Bay Preservation <br />Area Overlay District) of the Code of the City of Portsmouth, Virginia as shown on Exhibit <br />A hereto. <br />2. That that certain map titled "Chesapeake Bay Preservation Areas <br />Portsmouth, Virginia" dated November 25, 2025 and on file with the Planning Department, <br />a reduced copy of which is attached hereto as Exhibit B, is hereby confirmed to be the <br />current Chesapeake Bay Preservation Area Overlay District Map referenced in Section 9.1- <br />4 of Chapter 9.1. <br />3. That the purpose of the amendments is to comply with state law, including <br />implementing criteria for resiliency to be included in the performance standards for <br />development in Resource Protection Areas. <br />4. That Section 2 of this ordinance shall take effect on the date of adoption and <br />the remainder of this ordinance shall take effect on July 1, 2026. <br />ADOPTED by the Council of the City of Portsmouth, Virginia at a meeting held <br />on November 25, 2025. <br />Teste: <br />City Clerk <br />
