ORDINANCE NO. 2025-85 AN ORDINANCE AUTHORIZING PAYMENT OF ESCHEATED FUNDS FROM THE TAX SALE OF 3506 BLAINE STREET TO EDWIN CEDRIC WRIGHT, JEANNINE DELORIS GAINES, CAROL DEANS, TERRI L. DEANS-MCFARLANE, AND GAYLA KATERINA WRIGHT-MOLINA AS AUTHORIZED BY SECTION 58.1-3967 OF THE VIRGINIA CODE AND APPROPRIATING THE SUM OF $27,146.94 FROM THE FUND BALANCE OF THE GENERAL FUND TO THE FY 2026 GENERAL FUND BUDGET FOR SAID PURPOSE. WHEREAS, the property located at 3506 Blaine Street, Portsmouth, Virginia (the "Property"), was sold at a tax sale and, pursuant to Section 58.1-3967 of the Virginia Code, the surplus funds of that tax sale escheated to the city; and WHEREAS, Section 58.1-3967 of the Virginia Code provides that, after a city receives escheated funds from a tax sale, the former owner or their heirs and assigns may petition City Council to recover the escheated funds, and Council may, in its sole discretion, grant or deny the petition; and WHEREAS, Edwin Cedric Wright, Jeannine Deloris Gaines, Carol Deans, Terri L. Deans - McFarlane, and Gayla Katerina Wright -Molina, pursuant to Section 58.1-3967 of the Virginia Code, have, by counsel, written a request to the city for Council to pay them the escheated funds from the sale of the Property; and NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: 1. That it grants relief by authorizing the following payments, based on each individual's interest in the Property: $4,762.62 to Edwin Cedric Wright $4,762.62 to Jeannine Deloris Gaines $6,429.54 to Carol Deans $6,429.54 to Terri L. Deans -McFarlane $4,762.62 to Gayla Katerina Wright -Molina. 2. That the sum of $27,146.94 is appropriated from the Fund Balance of the General Fund to the FY 2026 General Fund Budget for said purpose. 3. That estimated revenues and expenditures in the City Treasurer's section of the FY 2026 General Fund Budget are increased by $27,146.94. 4. That this ordinance shall take effect immediately upon adoption.
