ORDINANCE NO. 2025-85 <br />AN ORDINANCE AUTHORIZING PAYMENT OF ESCHEATED FUNDS FROM THE <br />TAX SALE OF 3506 BLAINE STREET TO EDWIN CEDRIC WRIGHT, JEANNINE <br />DELORIS GAINES, CAROL DEANS, TERRI L. DEANS-MCFARLANE, AND GAYLA <br />KATERINA WRIGHT-MOLINA AS AUTHORIZED BY SECTION 58.1-3967 OF THE <br />VIRGINIA CODE AND APPROPRIATING THE SUM OF $27,146.94 FROM THE <br />FUND BALANCE OF THE GENERAL FUND TO THE FY 2026 GENERAL FUND <br />BUDGET FOR SAID PURPOSE. <br />WHEREAS, the property located at 3506 Blaine Street, Portsmouth, Virginia (the <br />"Property"), was sold at a tax sale and, pursuant to Section 58.1-3967 of the Virginia Code, the <br />surplus funds of that tax sale escheated to the city; and <br />WHEREAS, Section 58.1-3967 of the Virginia Code provides that, after a city receives <br />escheated funds from a tax sale, the former owner or their heirs and assigns may petition City <br />Council to recover the escheated funds, and Council may, in its sole discretion, grant or deny the <br />petition; and <br />WHEREAS, Edwin Cedric Wright, Jeannine Deloris Gaines, Carol Deans, Terri L. Deans - <br />McFarlane, and Gayla Katerina Wright -Molina, pursuant to Section 58.1-3967 of the Virginia <br />Code, have, by counsel, written a request to the city for Council to pay them the escheated funds <br />from the sale of the Property; and <br />NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br />1. That it grants relief by authorizing the following payments, based on each <br />individual's interest in the Property: <br />$4,762.62 to Edwin Cedric Wright <br />$4,762.62 to Jeannine Deloris Gaines <br />$6,429.54 to Carol Deans <br />$6,429.54 to Terri L. Deans -McFarlane <br />$4,762.62 to Gayla Katerina Wright -Molina. <br />2. That the sum of $27,146.94 is appropriated from the Fund Balance of the General <br />Fund to the FY 2026 General Fund Budget for said purpose. <br />3. That estimated revenues and expenditures in the City Treasurer's section of the <br />FY 2026 General Fund Budget are increased by $27,146.94. <br />4. That this ordinance shall take effect immediately upon adoption. <br />
