EXHIBIT A <br />The Code of the City of Portsmouth, Virginia is amended by adding the following new Chapter <br />11.1. <br />Chapter 11.1 EROSION AND STORMWATER MANAGEMENT <br />ARTICLE 1. EROSION AND STORMWA TER MANAGEMENT PROGRAM <br />Sec. 11.1-1. Title and purpose; authority. <br />(a) Title and purpose. This article shall be known as the "Erosion and Stormwater Management Ordinance of the <br />City of Portsmouth." <br />(b) The purpose of the article is to ensure the general health, safety and welfare of the citizens of Portsmouth, <br />protect the quality and quantity of state waters from the potential harm of unmanaged stormwater and soil <br />erosion, including protection from a land disturbing activity causing unreasonable degradation of properties, <br />water quality, stream channels, and other natural resources, and to establish procedures whereby <br />stormwater requirements related to water quality and quantity shall be administered and enforced. <br />(c) Authority. This chapter is authorized by Code of Virginia, § 62.1-44.15:27. <br />(d) This chapter shall be effective as of January 28, 2025. <br />Sec. 11.1-2. Definitions. <br />The following words, terms and phrases, when used in this chapter, shall have the meanings ascribed to <br />them in this section, except where the context clearly indicates a different meaning: <br />Administrator means the city engineer or his designee[s]. <br />Adequate channel means a channel that will convey the designated frequency storm event without <br />overtopping the channel bank nor causing erosive damage to the channel bed or banks. <br />Agreement in lieu of a plan means a contract between the city and the owner or permittee that specifies <br />methods that shall be implemented to comply with the requirements of the VESMA and this chapter for the <br />construction of a (i) single-family detached residential structure or (ii) farm building or structure on a parcel of land <br />with a total impervious cover percentage, including the impervious cover from the farm building or other structure <br />to be constructed, of less than five percent; such contract may be executed by the city in lieu of a soil erosion <br />control and stormwater management plan. <br />Applicant means a person submitting a soil erosion control and stormwater management plan to the city for <br />approval in order to obtain authorization to commence a land disturbing activity, or a person otherwise submitting <br />an application for a permit or requesting issuance of a permit under this chapter. <br />Best management practice or BMP means schedules of activities, prohibitions of practices, maintenance <br />procedures, and other management practices, including both structural and nonstructural practices, to prevent or <br />reduce the pollution of surface waters and groundwater systems. Nonproprietary best management practice <br />means both structural and nonstructural practices to prevent or reduce the pollution of surface waters and <br />groundwater systems that are in the public domain and are not protected by trademark or patent or copyright. <br />Proprietary best management practice means both structural and nonstructural practices to prevent or reduce the <br />Page 1 of 27 <br />
