portion of a parcel having an address of 2012 Victory Boulevard (Tax Parcel 0456-0010), <br />the said property being more particularly described as: <br />UP -25-03 <br />Portion of 2012 Victory Boulevard <br />(Tax Parcel 0456-0010) <br />THAT CERTAIN suite of the following described property that has a <br />designated mailing address of 4806 George Washington Highway: <br />ALL THAT certain lot, piece or parcel of land, with the buildings and <br />improvements thereon, situate, lying and being in the City of <br />Portsmouth, Virginia, and known, numbered and designated as <br />"PARCEL A-1 16.403 ACRES" as shown on that certain plat (the <br />"Parcel A-1 Plat") entitled "PHYSICAL SURVEY OF PARCEL A-1, <br />SUBDIVISION OF PRPOPERTY FOR FARM FRESH, INC. <br />LOCATED AT GEORGE WASHINGTON HIGHWAY & VICTORY <br />BLVD. FOR DOMINION CAPITAL, INC., PORTSMOUTH <br />VIRGINIA", dated October 20, 1993, and prepared by John Sirine and <br />Associates, Ltd., Surveyors, -Engineers -Planners, Virginia Beach, <br />Virginia, and duly recorded in the Clerk's Office of the Circuit Court <br />of Portsmouth, Virginia in Map Book 15, Page 124-127. <br />IT BEING the same property conveyed to Washington/Victory, LLC <br />by Deed from Williams Court/DCI Properties, Inc. dated May 26, <br />2006 and recorded in the Clerk's Office of the Circuit Court for the <br />City of Portsmouth, Virginia as Instrument Number 060012272. <br />6. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br />(a) The owner and the operator of the entertainment establishment shall <br />ensure and maintain compliance with the following use -specific standards, <br />including as set forth in subsection 40.2-217(G)(5)(b) of the Zoning <br />Ordinance: <br />(i) Entertainment establishments shall not create unreasonable <br />environmental aspects such as noise, odor, smoke, vibration, heat, <br />or glare. <br />(ii) Noise from the establishment shall comply with City Code Sec. <br />24-255 Unlawful Excessive Sound. <br />(iii) Any building housing live entertainment shall include soundproof <br />entryway and exit doors. <br />
