corrected by Deed of Correction recorded as Instrument Number <br />040003418. <br />TOGETHER WITH that perpetual easement of right of way contained <br />in that Agreement and Conveyance dated January 19, 1981 and <br />recorded in the Clerk's Office of the Circuit Court o the City of <br />Portsmouth, Virginia in Deed Book 800 at page 265; and contained in <br />that Deed of Easement dated November 20, 1987 and recorded in the <br />Clerk's Office of the Circuit Court of the City of Portsmouth, Virginia <br />in Deed Book 1001 at page 1904. <br />FURTHER TOGETHER WITH the ingress -egress easement reserved <br />in that certain Deed of Gift recorded in Deed Book 1319, page 758 in <br />the Clerk's Office of the Circuit Court of the City of Portsmouth, <br />Virginia. <br />IT BEING the same property conveyed to ST Tidewater, LLC by <br />Special Warranty Deed from GSKS Properties, LC, a Virginia limited <br />liability company, dated January 31, 2014 and recorded in the <br />Portsmouth Circuit Court Clerk's Office as Instrument Number <br />140001057. <br />6. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br />(a) Seaplane operations shall be limited to five (5) flights per day. <br />(b) Hours of operation shall be limited to daylight hours between sunrise and <br />sunset. <br />(c) Seaplanes shall not be stored on the property overnight. <br />(d) The use shall operate in compliance with all applicable Federal Aviation <br />Administration (FAA) Regulations. <br />(e) The use shall operate in compliance with all requirements imposed by the <br />Department of the Navy from time to time, including without limitation as <br />specified in the letter submitted to the United States Army Corps of <br />Engineers (USACE) in response to the Draft Environmental Assessment <br />(EA) and Draft Finding of No Significant Impact (FONSI) prepared by C. <br />A. Lahti on November 4, 2024. <br />(f) The use shall operate in compliance with all applicable codes, ordinances, <br />and regulations of federal, state and local government, and all required <br />licenses and permits shall be obtained prior to the commencement of <br />operation and remain in effect during the operation of the proposed use. <br />
