R-25-10 <br />A RESOLUTION DECLARING THAT THE CITY OF PORTSMOUTH WILL PROVIDE <br />THE WORKERS' COMPENSATION PRESUMPTIONS UNDER VIRGINIA CODE <br />SECTION 65.2-402(B) TO SALARIED EMERGENCY MEDICAL SERVICES <br />PERSONNEL. <br />WHEREAS, in 2021 the Virginia General Assembly amended § 65.2-402(B) of the Code <br />of Virginia to allow localities, by adoption of a resolution, to extend the workers' compensation <br />presumptions as to death or disability from hypertension or heart disease to salaried emergency <br />medical services personnel who have completed five years of service; and <br />WHEREAS, emergency medical services personnel employed by the City of Portsmouth <br />perform a valuable service to the community, frequently risking their health and safety for the <br />citizens of the City; and <br />WHEREAS, the City of Portsmouth values the services and sacrifices made by the <br />emergency medical services personnel of the City; and <br />WHEREAS, the City of Portsmouth desires to have its salaried emergency medical <br />services personnel covered by the presumptions included in Va. Code § 65.2-402(B) for heart <br />disease and hypertension to the maximum extent permitted by law; <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, <br />Virginia, that its salaried emergency medical services personnel, as that term is defined in Virginia <br />Code § 32.1-111.1, who have completed five years of service in their position, shall be covered by <br />the workers' compensation presumption as to both hypertension and heart disease in Va. Code § <br />65.2-402(B) to the maximum extent possible. <br />ADOPTED by the Council of the City of Portsmouth, Virginia at a meeting held on March <br />25, 2025. <br />
