Article V — Construction and Operational Matters <br />5.1 Construction Standards. The Authority shall install the Authority Fiber in a good <br />and workmanlike manner in accordance with industry standards for like work in the City, in <br />accordance with all City standards for such work and all lawful directions of governmental <br />authority; at a minimum, such construction shall conform to the standards set forth in that certain <br />Authority contract entitled "Danella Construction, Inc. SNA-IFB-2021-01" dated as of March 1, <br />2022 (the "Construction Contract"). <br />5.2 Inspection of Conduit Prior to Construction. Prior to installation of the Authority <br />Fiber, the Authority shall document the condition of the City Conduit in a manner customary of <br />engineering professionals carrying out like work in the City, to include: <br />a. the number and diameter of empty conduits, including the City Conduit in <br />which the Authority Fiber will be installed; <br />b. confirmation that all conduits contain pull ropes; <br />C. identification of any City Conduit that is not continuous, is obstructed, or <br />is otherwise unusable; and <br />d. physical labeling of unusable conduit at the endpoints of the unusable <br />section. <br />If the Authority discovers damage to the City Conduit that makes any section unusable, the <br />Authority shall immediately notify the City of its unusability. The City shall at that time have the <br />responsibility of undertaking diligent efforts to restore the City Conduit to usability or may <br />authorize the Authority to undertake such repairs. If the Authority undertakes such repairs, the <br />City understands that such work will result in a change order to the Construction Contract, and <br />the City agrees to bear the entire cost of such change order, without administrative markup to the <br />credit of the Authority. <br />5.3 Schedule. Installation of the Authority's facilities shall be substantially complete <br />not later than , and be finally complete and the Authority shall complete its work <br />to satisfy all City punchlists not later than thirty (30) days thereafter. <br />5.4 As -built Drawinps. The Authority shall provide the City as -built drawings upon <br />completion of the Construction Contract promptly upon the Authority's receipt of such drawings <br />from the contractor in accordance with the Construction Contract. <br />5.5 Maintenance and Repair Responsibilities. The City shall be responsible for the <br />operation, maintenance and repair of all City -owned conduit and ducts, including the City <br />Conduit. The Authority shall be responsible for operation, maintenance and repair of the <br />Authority's dark fiber, including the Authority Fiber. <br />5.8 Repair. In the event of the need for repair to the Authority Fiber only, the <br />Authority shall be solely responsible for the cost of repairing such fiber, and shall be solely <br />responsible for obtaining any necessary permits from, without limitation, the Virginia <br />3 <br />
