4.1.19.3. National Electrical Safety Code (NESC); <br />4.1.19.4. Obstruction Marking and Lighting, AC 70/7460 i.e., Federal <br />Aviation Administration; <br />4.1.19.5. Constructing, Marking and Lighting of Antenna Structures, Federal <br />Communications Commission Rules, Part 17; and <br />4.1.19.6. Requirements set forth in the Virginia Uniform Statewide Building <br />Code. <br />4.2. Interconnection: The Franchisee shall design its Cable System so that it may be <br />interconnected with other cable systems in the Franchise Area. Interconnection of systems may be <br />made by direct cable connection, microwave link, satellite, or other appropriate methods. <br />Interconnection capabilities shall be provided for the exchange of all PEG channels designated and <br />carried on the Cable System. Franchisee shall not be required to build such interconnection if it is <br />not economically feasible or be required to connect with an overbuilder. Franchisee may charge <br />connecting company in advance for any costs associated with the interconnection. <br />4.3. Emergency Alert System: Franchisee shall comply with the Emergency Alert <br />System ("EAS") requirements of the FCC in order that emergency messages may be distributed <br />over the System. In the event of a state or local civil emergency, the EAS shall be remotely <br />activated as set forth in the Virginia EAS plan. <br />5. PEG SERVICES <br />5.1. PEG Set Aside: <br />5.1.1. PEG Channels: In order to ensure universal availability of public, <br />educational and government programming, Franchisee shall provide on the Basic Service Tier, <br />two (2) dedicated Educational Access Channels, and one (1) dedicated Government Access <br />Channel (collectively, "PEG Channels") pursuant to this Article 5. Within six (6) months of this <br />signed agreement, the Franchise shall, without cost to the City, provide, provide, install, and <br />maintain in good working order the equipment necessary for transmitting such High -Definition <br />signals to Subscribers. Thereafter, the channels that have been converted shall be delivered in a <br />suitable High -Definition format for the remainder of the Term. Franchisee shall have the option to <br />provide the HD EG Access Channel(s) in a switched digital format on its system. The City may <br />request conversion of remaining channels at any time, up to the maximum of three. The EG Access <br />Channels shall be included as part of the Basic Service Tier. At such time as the HD EG Access <br />channels are available to subscribers in the Basic Service Tier, Franchisee shall no longer be <br />required to carry the EG Access Channels in standard definition. If a PEG Channel provided under <br />Section 5. 1.1 is not being utilized by the LFA, Franchisee may utilize such PEG Channel, in its <br />sole discretion, until such time as LFA elects to utilize the PEG Channel for its intended purpose. <br />5.1.2.
