written notice, but no more than once per year, a representative of the Franchisee will meet with <br />representatives of the LFA to confirm compliance with the requirements set forth in Subsection <br />3.1. Nothing herein shall prevent the LFA from contacting at any time the single point of contact <br />identified in Section 13.5 with respect to other matters regarding this Agreement. <br />3.2. Availability of Cable Service: Franchisee shall make Cable Service available to all <br />occupied residential dwelling units and may make Cable Service available to businesses within the <br />Service Area in conformance with Section 3.1 and Franchisee shall not discriminate between or <br />among any individuals in the availability of Cable Service. In the areas in which Franchisee shall <br />provide Cable Service, Franchisee shall be required to connect, at Franchisee's expense, other than <br />a standard installation charge, all occupied residential dwelling units that are within one hundred <br />twenty-five (125) feet of trunk or feeder lines not otherwise already served by Franchisee's Cable <br />System. Franchisee shall be allowed to recover, from a Subscriber that requests such connection, <br />actual costs incurred for residential dwelling unit connections that exceed one hundred twenty-five <br />(125) feet and actual costs incurred to connect any non-residential dwelling unit Subscriber. <br />3.3. Cable Service to Municipal Buildings: Subject to 3.1 and so long as such <br />requirement applies to one or more other cable operators in the Franchise Area, Franchisee shall <br />provide, without charge within the Service Area, one service outlet activated for the basic service <br />tier and expanded service tier or the future equivalent of such tiers of service ("Free Service") and <br />one (1) set top box, if necessary, to each fire station, public school, police station, public library, <br />and any other local government building as set forth in Exhibit A and to no more than two (2) <br />newly constructed or acquired local government buildings eligible for service pursuant to this <br />Section 3.3 ("Additional Buildings") in any given calendar year, up to a maximum total number <br />of Additional Buildings equivalent to one (1) per year over the Term of this Agreement. If it is <br />necessary to extend Franchisee's trunk or feeder lines more than two hundred -fifty (250) feet solely <br />to provide service to any such school or public building, the LFA shall have the option either of <br />paying Franchisee's direct costs for such extension in excess of two hundred -fifty (250) feet, or of <br />releasing Franchisee from the obligation to provide service to such building. Furthermore, <br />Franchisee shall be permitted to recover, from any school or other public building owner entitled <br />to free service, the direct cost of installing, when requested to do so, more than one outlet, or <br />concealed inside wiring, or a service outlet requiring more than two hundred fifty (250) feet of <br />drop cable; provided, however, that the Franchisee shall not charge for the provision of Free <br />Service to the additional service outlets once installed, but reserves the right to charge for <br />equipment including additional set top boxes at then -commercial rates. If Franchisee can't perform <br />inside wiring and/or additional outlet installation to public buildings the LFA or building owners <br />may retain qualified third -party contractors to perform such work. Cable Service may not be resold <br />or otherwise used in contravention of Franchisee's rights with third parties respecting <br />programming. Equipment provided by Franchisee, if any, shall be replaced at retail rates if lost, <br />stolen or damaged. The requirements of this Section 3.3 shall not apply in cases where it is not <br />technically feasible for the Franchisee to comply. <br />4. SYSTEM FACILITIES <br />4.1. System Characteristics: The Franchisee's Cable System shall meet or exceed the <br />following requirements: <br />
