ORDINANCE NO. 2024-134 <br />AN ORDINANCE GRANTING A RENEWAL OF A NON-EXCLUSIVE CABLE <br />FRANCHISE TO COX COMMUNICATIONS HAMPTON ROADS, LLC TO <br />CONSTRUCT, OPERATE AND MAINTAIN A CABLE SYSTEM IN THE CITY OF <br />PORTSMOUTH. <br />WHEREAS, pursuant to Ordinance 2008-82 adopted on December 9, 2008, the City of <br />Portsmouth entered into a Cable Franchise Agreement (the "Franchise Agreement") with Cox <br />Communications Hampton Roads, LLC (including its successors in interest to the Agreement, <br />"Cox"); and <br />WHEREAS, the Franchise Agreement, including extensions, will expire on December 10, <br />2024, and Cox has proposed a renewal of its Franchise Agreement; and <br />WHEREAS, the requirements of Section 626 of the Cable Act, 47 USC § 546 and Virginia <br />Code § 15.2-2108.19, et seq. for cable franchise renewals have been met; <br />NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br />1. That the City Council hereby grants Cox a renewal of its Cable Franchise to <br />construct, operate, and maintain a cable system in the City of Portsmouth pursuant to the terms <br />outlined in Exhibit A, entitled "Cable Franchise Agreement," that is attached hereto and made a <br />part thereof. <br />2. That the City Manager is authorized to execute said Cable Franchise Agreement on <br />behalf of the City of Portsmouth in accordance with the terms of this Ordinance. <br />3. That this ordinance shall take effect on the date of adoption. <br />ADOPTED by the Council of the City of Portsmouth, Virginia at a meeting held on <br />December 10, 2024. <br />Teste: <br />City Clerk <br />
