R-24-21 <br />A RESOLUTION AUTHORIZING THE ACQUISITION OF A STORMWATER <br />DRAINAGE EASEMENT FROM THE UNITED STATES OF AMERICA (CRANEY <br />ISLAND DISPOSAL AREA). <br />WHEREAS, by Easement for Right of Way dated October 10, 1973, as supplemented by <br />Supplemental Agreement No. 1 dated August 6, 1974 and Supplemental Agreement No. 2 dated <br />April 12, 1999, the United States of America, through the Secretary of the Army, granted the <br />City a 15 foot stormwater drainage easement for the placement of 24 inch drainage pipe to the <br />north of Rivershore Road, as shown on Exhibit A hereto (the "Prior Easement"); and <br />WHEREAS, the term of the Prior Easement was fifty years and it has now expired; and <br />WHEREAS, the Army Corps of Engineers has offered to grant the City a new easement <br />for the same location; and <br />WHEREAS, the cost of the new easement is anticipated to be $9,000, which is the <br />Army's internal cost for preparing the new easement documents; <br />NOW THEREFORE BE IT RESOLVED by the Council of the City of Portsmouth, <br />Virginia that it hereby approves and authorizes the acquisition of a new easement to replace the <br />Prior Easement for a purchase price of approximately $9,000, and be it further resolved that the <br />City Manager is authorized to deliver the purchase price and execute such documents or <br />instruments as may be necessary or desirable in furtherance of the intent of this Resolution. <br />ADOPTED by the Council of the City of Portsmouth, Virginia at a meeting held on <br />August 13, 2024. <br />Teste: <br />City Clerk <br />
