5. That a use permit is hereby granted pursuant to Section 40.2-533 of the <br />Code of the City of Portsmouth, Virginia to operate a shipping container/chassis storage <br />yard on a 7.04 acre portion of the 96.5 acre parcel having an address of 0 Syer Road (Tax <br />Parcel 3000-0900), the said property being more particularly described as: <br />UP -24-06 <br />7.04 acre portion of <br />0 Syer Road <br />(Tax Parcel 3000-0900) <br />THAT CERTAIN portion of the 96.5 -acre CSX Transportation, Inc. <br />property located at 0 Syer Road consisting of approximately 7.04 acres <br />and extending northwesterly from Columbus Avenue and thence <br />northeasterly, as shown more particularly on Exhibits A-1, A-2, and <br />A-3 attached hereto. <br />6. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br />(a) In addition to all applicable general standards, the proposed use shall be <br />designed and operated in accordance with the use -specific standards for <br />shipping container/chassis storage yard uses outlined in Section 40.2- <br />217(H)(3)(b) of the Zoning Ordinance. <br />(b) Prior to commencing the use, a formal Site Plan must be approved by the <br />Engineering Department. <br />(c) Prior to commencing the use, a Zoning Clearance must be obtained from <br />the Zoning Administrator and a Business License must be obtained from <br />the Commissioner of the Revenue. <br />(d) If at any time a building is added to the site, the owner/operator must <br />comply with all applicable off-street parking and loading and circulation <br />requirements of the Zoning Ordinance, including without limitation the <br />requirements of Section 40.2-301. <br />(e) The development must be constructed in compliance with all applicable <br />codes, ordinances, and regulations of federal, state, and local governments, <br />and all required licenses and permits must be obtained prior to <br />construction and remain in effect during the operation of the development. <br />(f) All taxes/fees associated with the property shall be paid when due, as <br />determined by the City Treasurer. <br />
