465 Dinwiddie Street <br />(Tax Parcel 0012-1030) <br />ALL THAT certain parcel of land lying, situate and being in the City <br />of Portsmouth, Virginia, and more particularly described on that <br />certain plat entitled "Physical Survey of #465 Dinwiddie Street, (REF. <br />D.B. 292, Pg. 218), Portsmouth, Virginia, for G. Bill Backus & S. <br />Talmadge Carey", dated January 5, 1988 and made by Ernest C. <br />Hawkins, Jr. and Associates, Surveyors and Planners, Suffolk, <br />Virginia, which plat is duly recorded in the Clerk's Office of the <br />Circuit Court of the City of Portsmouth, Virginia, in Deed Book 1000 <br />at page 1814, to which plat reference is hereby made for a more <br />particular description of said property; said property fronting 33.17 <br />feet on Dinwiddie Street and having a depth of 73.6 feet. <br />IT BEING the same property conveyed to K & O Acquisitions LLC by <br />Deed from Patricia Bucher Woodward, a/k/a Patricia B. Woodward <br />dated March 27, 2024 and recorded in the Portsmouth Circuit Court <br />Clerk's Office as Instrument Number 202403044. <br />6. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br />(a) Without limitation, the establishment shall be maintained and operated in <br />compliance with the following standards: <br />(i) The use shall not create unreasonable environmental aspects such <br />as noise, odor, smoke, vibration, heat, or glare. <br />(ii) Noise from the establishment shall comply with City Code Section <br />24-255 Unlawful Excessive Sound. <br />(iii) Any building housing live entertainment shall include soundproof <br />entryway and exit doors. <br />(b) Prior to initially operating the approved use and so long as the use remains <br />in operation, the owners and/or operators shall install and maintain digital <br />video equipment with recording capabilities sufficient to indicate the date <br />and time that the recording is made. The recording shall provide <br />surveillance coverage encompassing the front, side, and rear exteriors of <br />the establishment for 24 hours a day, 7 days a week. Recorded data must <br />be maintained in a condition permitting review of the information for a <br />period of no less than thirty days. <br />(c) Where required by the Zoning Ordinance, all external site and building <br />improvements, including signage, must be approved through issuance of a <br />
