(c) The proposed development shall be in substantial compliance with the <br />concept plan entitled "Preliminary Site Plan for Map Parcel 03080750" <br />submitted on January 10, 2024, except where modifications may be <br />required to comply with all applicable local, state, and federal codes and <br />regulations. <br />(d) The development shall be in substantial compliance, including with <br />respect to building design, construction materials, and concept exterior <br />elevations, as shown in the elevations submitted on January 12, 2024, <br />except where modifications may be required to comply with all applicable <br />local, state, and federal codes and regulations, including City Code <br />Chapter 14.1 (Flood Protection). <br />(e) The development of the subject property shall not include more than three <br />(3) townhouses. <br />(f) The development shall be constructed in compliance with use -specific <br />standards for townhouse dwellings and multi -family dwellings in <br />accordance with Zoning Ordinance Sections 40.2-217(D)(1)(d) and <br />(D)(1)(e). <br />(g) Prior to Site Plan Review approval, a minor subdivision plat to subdivide <br />the subject property into three (3) parcels for townhouses in accordance <br />with Chapter 33.1 of the City Code (Subdivisions) must be approved by <br />the City and recorded in the Circuit Court land records by the developer. <br />(h) The developer must submit a Site Plan to the Engineering Department for <br />review and approval. Without limitation, the Site Plan must comply with <br />Chapter 31.2 of the City Code (Stormwater Management). The Site Plan <br />will be reviewed by the City to ensure compliance with all applicable <br />local, state, and federal codes and regulations. <br />(i) No trash cans shall be stored in the front or side yards of the development. <br />(j) The development shall be constructed in compliance with all applicable <br />codes, ordinances and regulations of federal, state, and local government, <br />and all required licenses and permits shall be obtained prior to <br />construction and, as applicable, maintained in effect during the operation <br />of the development. <br />(k) All taxes/fees associated with the property shall be paid when due, as <br />determined by the City treasurer. <br />7. REVOCATION OF PERMIT: Violation of any of the conditions set <br />forth herein may serve as grounds for revocation of the use permit by City Council. <br />
