R-24-27 <br />A RESOLUTION AUTHORIZING THE CITY MANAGER TO APPROVE A <br />CHANGE ORDER TOTALING MORE THAN 25% OF THE ORIGINAL <br />CONTRACT PRICE OF THE CONTRACT WITH TIDEWATER UTILITY <br />CONSTRUCTION, INC. FOR THE COURT STREET GREEN STREET <br />PROJECT. <br />WHEREAS, the Court Street Green Street Project (the "Project") is a <br />demonstration project that incorporates "Complete Street" concepts and green <br />infrastructure to treat stormwater flows on top of a street segment within an area that is part <br />of the Downtown Master Utility Project; and <br />WHEREAS, the Project satisfies one of the City's MS -4 Stormwater Permit <br />requirements for performing retrofit projects and has been partially funded by state grants <br />in the amount of $2,232,712.62; and <br />WHEREAS, in 2021 Tidewater Utility Construction, Inc. submitted the low bid <br />for the Project and was awarded the contract for an original price of $3,920,993.05 (the <br />"Original Contract Price"); and <br />WHEREAS, the City provided a Notice to Proceed with the Project on August 16, <br />2021; and <br />WHEREAS, the following factors have resulted in the Project costing more than <br />anticipated: <br />• Unanticipated conditions associated with aging facilities and <br />conflicting records required additional work to upgrade and replace <br />water and sanitary sewer facilities; <br />• Unanticipated delays associated with private utility relocations <br />necessary to perform the work caused slowdowns in 2022 and <br />resulted in a work stoppage from September 2022 until August <br />2023; <br />• The delays resulted in increased subcontractor pricing as <br />construction costs in general spiked during the period of <br />performance of the Project; <br />• Unsuitable soils and other unanticipated conditions increased costs. <br />WHEREAS, as a result of these factors, previous change orders in the amount of <br />$948,981.43 have been approved and it is anticipated that an additional $1,529,087.10 is <br />necessary to complete the Project; and <br />WHEREAS, Section 12-183 of the City Code requires Council approval to <br />increase an original fixed price contract amount by more than 25% or $50,000, whichever <br />is greater; and <br />
