3 t° A 2023 -26 <br />ZONING AMENDMENT ORDINANCE Z -23 -01 <br />BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br />1. That the portion of the zoning map attached to and made a part of the City <br />of Portsmouth Zoning Ordinance, which now zones as GMU, General Mixed Use the <br />property described in Petition for Zoning Amendment Number Z- 23 -01, is hereby <br />amended and changed so as to show said property zoned as UR -M, Multi- Family Urban <br />Residential, and that said property is hereby zoned as UR -M, Multi - Family Urban <br />Residential. <br />2. That the property affected by this ordinance by being zoned from GMU, <br />General Mixed Use to UR -M, Multi- Family Urban Residential is furthermore described <br />as follows: <br />Z -23 -01 <br />5125/5129 Deep Creel Boulevard <br />(Tax Parcel 0453 -0080) <br />ALL THAT certain piece or parcel of land situate, lying and being in <br />the City of Portsmouth, Virginia, with the improvements thereon, <br />bounded and described as follows: <br />BEGINNING at a point marked by an iron pipe on the East side of <br />Deep Creek Boulevard where the Northern line of the right -of -way of <br />Virginian Railway intersects the said Deep Creek Boulevard; thence in <br />a Northerly direction down the right -of -way of Deep Creek Boulevard <br />one hundred sixty -six feet and five tenths (166.5) to the land formerly <br />owned by Franklin F. Fowler; thence down the land formerly owned <br />by Franklin F. Fowler East two hundred and forty -five (245) feet; <br />thence running North along the land formerly owned by Franklin F. <br />Fowler sixty (60) feet; thence running in an Easterly direction thirty - <br />five hundredths (0.35) feet to an iron pipe; thence South thirty -nine <br />(39) degrees thirty -eight (38) minutes East one hundred thirty -seven <br />and seven tenths (137.7) feet to the right -of -way of Virginian Railway; <br />thence down the right -of -way of the Virginian Railway South eighty - <br />four (84) degrees fifty -one (5 1) minutes West three hundred eighty - <br />nine and seven tenths (389.7) feet to the point of beginning. <br />IT BEING the same property conveyed to Dollhouse Investments, <br />LLC by Deed of Bargain and Sale from Jason R. McCracken dated <br />December 29, 2021 and recorded in the Clerk's Office of the Circuit <br />Court for the City of Portsmouth, Virginia as Instrument Number <br />202200212. <br />
