i 2023 -60 <br />AN ORDINANCE AMENDING AND RE- ORDAINING SECTIONS 9 -2 <br />(PERMISSIBLE PLACES OF BURIAL) AND 9 -26 (BURIAL GROUNDS, CITY <br />CEMETERIES DESIGNATED) AND SUBSECTION 9 -29(A) (PERPETUAL <br />CARE OF CITY CEMETERIES; CEMETERY TRUST FUND) OF ARTICLES I <br />AND II OF CHAPTER 9 OF THE CODE OF THE CITY OF PORTSMOUTH, <br />VIRGINIA FOR THE PURPOSE OF DESIGNATING LINCOLN MEMORIAL <br />CEMETERY AS A CITY CEMETERY. <br />BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br />1. That Section 9 -2 of Article I of Chapter 9 of the Code of the City of <br />Portsmouth, Virginia (2006) be amended and reordained as follows: <br />Sec. 9 -2. Permissible places of burial. <br />(a) No person shall bury or cause to be buried, without permission of the director of <br />public health, the remains of any person in any private lot or at any other place <br />within the city except in Cedar Grove Cemetery, Oak Grove Cemetery, Olive <br />Branch Cemetery, Olive Branch Annex Cemetery, Lincoln Memorial Cemetery <br />Pafk, Saint Paul Cemetery, Evergreen Memorial Park, the cemeteries on Paradise <br />Creek belonging to the congregations of Gomley Chesed Synagogue and Chevra <br />Thilim Synagogue, and the cemetery belonging to Olive Branch Baptist Church and <br />Oak Grove Baptist Church; provided, however, that the remains of no person shall <br />be buried in the cemetery belonging to Olive Branch Baptist Church within 60 feet <br />of the centerline of Airline Boulevard. <br />(b) A violation of this section shall constitute a class 1 misdemeanor. <br />2. That Section 9 -26 of Article II of Chapter 9 of the Code of the City of <br />Portsmouth, Virginia (2006) be amended and reordained as follows: <br />Sec. 9 -26. Burial grounds, city cemeteries designated. <br />(a) The burial ground at Glasgow Street and Fort Lane shall be known as "Cedar Grove <br />Cemetery." The burial ground at London Boulevard and Peninsula Avenue shall be <br />known as "Oak Grove Cemetery." The burial grounds adjoining City Park and <br />Clifford Street shall be known as "Olive Branch Cemetery," and "Olive Branch <br />Annex Cemetery." The burial ground located on Pulaski Street in the Prentis Park <br />neighborhood shall be known as the "Mount Calvary Cemetery Complex" and shall <br />include Mount Calvary Cemetery, Fisher's Hill Cemetery, the Pauper's Field <br />Cemetery, and Mount Olive Cemetery. The burial ground located in the 3900 block <br />of D n Creek Boulevard shall be known as "Lincoln Memorial Cemetery." <br />(b) Cedar Grove Cemetery, Oak Grove Cemetery, Olive Branch Cemetery, the <br />Mount Calvary Cemetery Complex - a - nd Lincoln Memorial Cemetery are hereby <br />designated as city cemeteries. For the purposes of this chapter, the term "city <br />cemeteries" shall mean only those cemeteries so designated in this section. <br />
