(5) They shall include at least one improved access from a public sidewalk, <br />street, trail, or easement that includes signage designating the access point. <br />(D) Not Counted as Open Space Set - Asides. The following areas shall not be <br />counted as open space set- aside: <br />(1) Protected water features such as wetlands; <br />(2) Private yards not subject to an open space or conservation easement; <br />(3) Public street rights -of -way or private street easements, including sidewalks <br />located within those rights -of -way or easements; <br />(4) Open parking areas and driveways; <br />(5) Land covered by structures not designated for active or passive recreational <br />uses; and <br />(6) Designated outdoor storage areas. <br />33. Subsection 40.2- 533(K) of the City Code is amended as follows. <br />Sec. 40.2 -533. Use Permits. <br />(K) Expiration and Extension. <br />(1) Except as provided for in subsection (2) and (3) below, a Use Permit shall <br />automatically expire and become void two years from the date of approval <br />by City Council if the use is inactive or changed to a different use, unless <br />within such two -year period: <br />(a) A building permit is obtained and erection or alteration of a structure is <br />started; or <br />(b) A Certificate of Occupancy is obtained and the approved use is <br />commenced. <br />(c) For the purposes of this section, the starting of erection of a structure <br />shall mean the completion of all foundation work, and the starting of <br />alteration of a structure shall mean the completion of all demolition <br />work required prior to construction of alteration improvements. <br />(d) An extension is granted by the Virginia General Assembly. <br />34. Subsection 40.2- 535(H) of the City Code is amended as follows. <br />Sec. 40.2 -535.
