R -23 -28 <br />A RESOLUTION AUTHORIZING THE CITY MANAGER TO APPROVE A <br />CHANGE ORDER TOTALING MORE THAN 25% OF THE CONTRACT PRICE <br />OF THE CONSTRUCTION CONTRACT WITH CONRAD BROTHERS, INC. <br />FOR EXTERIOR RENOVATIONS AND HVAC IMPROVEMENTS TO THE ELM <br />AVENUE NEIGHBORHOOD FACILITY. <br />WHEREAS, in 2022 the City solicited bids for exterior renovations (including roof <br />replacement) and HVAC improvements to the Elm Avenue Neighborhood Facility (the <br />"Work "); and <br />WHEREAS, Conrad Brothers, Inc. (the "Contractor ") submitted the low bid; and <br />WHEREAS, the City entered into a contract dated May 5, 2022 with the Contractor <br />for the performance of the Work; and <br />WHEREAS, after demolition of the existing roof was completed, the City <br />determined that the interior deterioration in the facility was worse than anticipated and new <br />environmental concerns were discovered; and <br />WHEREAS, the City has worked with its consultant and the Contractor to <br />determine the preliminary scope of the repairs required to address these issues; and <br />WHEREAS, the City and its consultant have determined that the required repairs <br />are anticipated to cost at least $544,00 (subject to additional modifications which may be <br />necessary based on continued evaluation of the structure); and <br />WHEREAS, the original contract price for performance of the Work was <br />$1,376,000; and <br />WHEREAS, the change to the project scope to address the newly discovered <br />deterioration and environmental concerns and will result in additional material and <br />construction costs that will exceed 25% of the original contract amount; and <br />WHEREAS, Section 12 -183 of the City Code requires Council approval to exceed <br />an original contract amount by more than 25% or $50,000, whichever is greater; and <br />WHEREAS, it is projected that the final project cost will be approximately <br />$1,920,000, and funding to complete the project is available through the Community <br />Development Block Grant program and the Capital Improvement Fund. <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia that, pursuant to Section 12 -183 of the City Code, the City Manager <br />is authorized to expend the additional finds necessary to address the newly discovered <br />deterioration and environmental concerns, and to complete the Elm Avenue Neighborhood <br />Facility Renovation and HVAC Improvement Project. <br />
