R -23 -28 A RESOLUTION AUTHORIZING THE CITY MANAGER TO APPROVE A CHANGE ORDER TOTALING MORE THAN 25% OF THE CONTRACT PRICE OF THE CONSTRUCTION CONTRACT WITH CONRAD BROTHERS, INC. FOR EXTERIOR RENOVATIONS AND HVAC IMPROVEMENTS TO THE ELM AVENUE NEIGHBORHOOD FACILITY. WHEREAS, in 2022 the City solicited bids for exterior renovations (including roof replacement) and HVAC improvements to the Elm Avenue Neighborhood Facility (the "Work "); and WHEREAS, Conrad Brothers, Inc. (the "Contractor ") submitted the low bid; and WHEREAS, the City entered into a contract dated May 5, 2022 with the Contractor for the performance of the Work; and WHEREAS, after demolition of the existing roof was completed, the City determined that the interior deterioration in the facility was worse than anticipated and new environmental concerns were discovered; and WHEREAS, the City has worked with its consultant and the Contractor to determine the preliminary scope of the repairs required to address these issues; and WHEREAS, the City and its consultant have determined that the required repairs are anticipated to cost at least $544,00 (subject to additional modifications which may be necessary based on continued evaluation of the structure); and WHEREAS, the original contract price for performance of the Work was $1,376,000; and WHEREAS, the change to the project scope to address the newly discovered deterioration and environmental concerns and will result in additional material and construction costs that will exceed 25% of the original contract amount; and WHEREAS, Section 12 -183 of the City Code requires Council approval to exceed an original contract amount by more than 25% or $50,000, whichever is greater; and WHEREAS, it is projected that the final project cost will be approximately $1,920,000, and funding to complete the project is available through the Community Development Block Grant program and the Capital Improvement Fund. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia that, pursuant to Section 12 -183 of the City Code, the City Manager is authorized to expend the additional finds necessary to address the newly discovered deterioration and environmental concerns, and to complete the Elm Avenue Neighborhood Facility Renovation and HVAC Improvement Project.
