6. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br />(a) The development shall be in substantial compliance with the concept plan <br />entitled A4 Landing at High Street prepared by Hoggard -Eure Associates, <br />PC dated March 14, 2023, except as otherwise expressly stated in this <br />Section 6 or where modifications are required to comply with all <br />applicable local, state and federal codes and regulations. <br />(b) The development shall be in substantial compliance with the rendered <br />concept elevations and proposed materials board titled titled Kings <br />Landing at High Street Townhonies prepared by Retnauer Baynes <br />Associates, LLC dated December 16, 2022, except where modifications <br />may be required to comply with all applicable local, state, and federal <br />codes and regulations. <br />(c) Townhouse dwelling lots shall be subdivided in accordance with Chapter <br />33.1 of the City Code (Subdivision Ordinance) prior to Site Plan review <br />approval. <br />(d) Not more than 52 townhouse dwelling units shall be constructed and <br />operated on the subject property. <br />(e) The development must include a minimum of two (2) pedestrian access <br />paths along High Street to ensure adequate pedestrian connectivity and <br />accessibility to the public right -of -way. <br />(f) The development shall include streetscape improvements along all street <br />frontages, including those consistent with the current Complete High <br />Street Innovation Corridor Mnitiniodal Concept Plan, subject to any <br />deviations approved by the City Engineer. <br />(g) Vegetation shall be installed in accordance with Section 40.2 -304 of the <br />Zoning Ordinance, to include native landscaping that provides a fully <br />opaque screen to the minimum height necessary to fully screen the <br />development's BMP from the public right -of -way. The plan and design <br />for vegetation must be approved by the Zoning Administrator prior to Site <br />Plan review approval. <br />(h) The development shall be constructed in compliance with all applicable <br />codes, ordinances and regulations of federal, state and local government, <br />and all required licenses and permits shall be obtained and remain in effect <br />during the operation of the development. <br />
