R -23 -19 A RESOLUTION AUTHORIZING THE CONVEYANCE OF VARIOUS TITLE INTERESTS IN THREE PARCELS OF PROPERTY OWNED BY THE CITY OF PORTSMOUTH IN THE VICINITY OF PITCHKETTLE ROAD TO THE CITY OF SUFFOLK IN FURTHERANCE OF THE PITCHKETTLE ROAD REALIGNMENT PROJECT. WHEREAS, the City of Suffolk is undertaking a public works project to realign Pitchkettle Road (the "Project "); and WHEREAS, the City of Portsmouth owns various properties in Suffolk that serve as a watershed to protect the City's reservoir lakes from runoff; and WHEREAS, as part of the Project, Suffolk will install stormwater Best Management Practices that will have the effect of providing additional protection against runoff polluting Lake Meade; WHEREAS, in furtherance of the Project, Suffolk is requesting that the City convey the following interests in Tax Parcel 34B *EB20 *21: fee conveyance of a 9,632 square foot area for right of way and conveyance of a 2,445 square foot permanent non - exclusive utility easement, all as shown on Exhibit A; and WHEREAS, in furtherance of the Project, Suffolk is requesting that the City convey the following interests in Tax Parcel 34B *EB27: fee conveyance of a 170 square foot area for right of way; conveyance of a 971 square foot permanent drainage easement; and conveyance of a 1,204 square foot permanent non - exclusive utility easement, all as shown on Exhibit B; and WHEREAS, in furtherance of the Project, Suffolk is requesting that the City convey the following interests in Tax Parcel 34* 10: fee conveyance of a 10,257 square foot area for right of way; conveyance of a 222 square foot temporary construction easement; conveyance of a 6,046 square foot permanent drainage easement; and conveyance of a 5,288 square foot permanent non - exclusive utility easement, all as shown on Exhibit C; and WHEREAS, the Department of Public Utilities has reviewed the proposed conveyances and determined that they will have no negative impact on the City's watershed, and that the Project as a whole will benefit Lake Meade; NOW THEREFORE BE IT RESOLVED by the Council of the City of Portsmouth, Virginia that it hereby approves and authorizes the conveyance of the requested property interests to the City of Suffolk and that the City Manager is hereby authorized to execute such documents or instruments as may be necessary or desirable in furtherance of the intent of this Resolution.
