R -23 -11 A RESOLUTION AUTHORIZING THE GRANT OF A PRIVATE DRAINAGE EASEMENT TO SUFFOLK BENTON, LLC ENCUMBERING APPROXIMATELY FORTY -FIVE HUNDREDTHS OF AN ACRE OF PROPERTY OWNED BY THE CITY OF PORTSMOUTH AT 1227 HOLLAND ROAD (TAX PARCEL 34 *35) IN SUFFOLK. WHEREAS, the City of Portsmouth owns 1227 Holland Road in Suffolk, an approximately 905 -acre parcel that serves as part of the watershed protecting the City's reservoir lakes (the "Property "); and WHEREAS, Suffolk Benton, LLC, the owner of an adjacent parcel, is requesting that the City grant a private drainage easement encumbering approximately forty -five hundredths of an acre of the Property; and WHEREAS, the Department of Public Utilities manages the City's watershed properties in Suffolk and has determined that the requested easement will not have any negative impact on the Property or the City's watershed; and WHEREAS, the grant of the requested easement will not impact the future value of the Property, because it is the City's intent that the Property always remain an undeveloped watershed; and WHEREAS, Suffolk Benton, LLC has offered to pay $5,000 to the City in consideration for the easement, which is substantially more than the easement's appraised value; and WHEREAS, City Council has conducted a public hearing on the proposed conveyance of the easement in accordance with the requirements of the Virginia Code; NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That it authorizes the grant of a private drainage easement encumbering approximately forty -five hundredths of an acre of 1227 Holland Road (Tax Parcel 34 *35) in Suffolk to Suffolk Benton, LLC or its assigns for a price of $5,000. 2. That the easement shall be substantially as shown on that certain "Exhibit Showing Variable Width Private Drainage Easement on Tax Parcel 34 *35 for the Benefit of Tax Parcel 34 *66 Holy Neck Borough Suffolk, Virginia" prepared by MSA, P.C., dated December 7, 2022, and attached hereto as Exhibit A. 3. That the City Manager is authorized to execute and deliver such instruments and documents, and to take such further actions, as may be necessary or desirable in furtherance of the purpose of this Resolution. 4. That this Resolution shall take effect on the date of its adoption. ADOPTED by the Council of the City of Portsmouth, Virginia at a meeting held on February 28, 2023. Teste: City Clerk
