(c) The development, at not cost to the City, shall comply with the <br />recommendations (whether on -site or off -site) included in the Traffic <br />Impact Analysis prepared by Ripley Heatwole Company and McPherson <br />Consulting, LLC dated July 2020, as approved by the City Engineer. <br />(d) The developer /owner /operator of the development shall coordinate with <br />the City Engineer and the Department of Engineering regarding traffic <br />issues along adjacent streets. <br />(e) Not more than 192 dwelling units shall be constructed on the 5601 High <br />Street property. <br />(f) Not more than 40 dwelling units shall be constructed on the 3109 Tyre <br />Neck Road property. <br />(g) The development shall be constructed and operated in compliance with all <br />applicable codes, ordinances and regulations of federal, state, and local <br />government, and all required licenses and permits shall be obtained and <br />maintained in good standing during the operation of the development. <br />(h) Prior to initially occupying and operating the approved use and so long as <br />the use remains in operation, the owners and /or operators shall install and <br />maintain digital video equipment with recording capabilities sufficient to <br />indicate the date and time that the recording is made. The recording shall <br />provide surveillance coverage encompassing the front, side, and rear <br />exteriors of the establishment for 24 hours a day, 7 days a week. <br />Recorded data must be maintained in a condition permitting review of the <br />information for a period of no less than thirty days. <br />(1) All taxes /fees associated with the property and /or the proposed use must <br />be paid when due, as determined by the City Treasurer. <br />7. REVOCATION OF PERMIT: Without limitation, violation of any of <br />the conditions set forth herein may serve as grounds for revocation of the use permit by <br />City Council.
