UP -23-17 <br />2884 Airline Boulevard <br />(Tax Parcel 0577-0200) <br />ALL THAT certain lot, piece or parcel of land, with the buildings and <br />improvements thereon, situate, lying and being in the City of <br />Portsmouth, Virginia, and being known, numbered and designated as <br />"Parcel B-1", as shown on that certain plat entitled. "Resubdivision of <br />A Parcel of Land located at 2850 Airline Boulevard (Instr. <br />#060005183) and Parcel B, Subdivision of Collinswood, Section One <br />(M.B. 3 P. 94) Portsmouth, Virginia", made by DKT Associates Land <br />Surveyors, dated June 30, 2016, which said plat is duly recorded in the <br />Clerk's Office of the Circuit Court of the City of Portsmouth, Virginia, <br />in Map Book 24 at page 137, to which reference is hereby made for a <br />more particular description of said property. <br />IT BEING that certain property conveyed to Victory West Thrill Park, <br />LLC, a Virginia limited liability company, by Deed from Zway II, <br />L.L.C. dated May 3, 2017 and recorded in the Portsmouth Circuit <br />Court Clerk's Office as Instrument Number 170004603. <br />6. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br />(a) Without limitation, the establishment shall be maintained and operated in <br />compliance with the following use -specific standards set forth in Zoning <br />Ordinance Sec. 40.2-217(G)(4)(b). <br />(i) Entertainment establishments shall not create unreasonable <br />environmental aspects such as noise, odor, smoke, vibration, heat, or glare. <br />(ii) Noise from the establishment shall comply with City Code Sec. 24- <br />255 Unlawful Excessive Sound. <br />(iii) Any building housing live entertainment shall include soundproof <br />entryway and exit doors. <br />(b) Prior to initially operating the approved use and so long as the use remains <br />in operation, the owners and/or operators shall install and maintain digital <br />video equipment with recording capabilities sufficient to indicate the date <br />and time that the recording is made. The recording shall provide <br />surveillance coverage encompassing the front, side, and rear exteriors of <br />the establishment for 24 hours a day, 7 days a week. Recorded data must <br />be maintained in a condition permitting review of the information for a <br />period of no less than thirty days. <br />
