960CE 2022 -26 AN ORDINANCE TO AMEND DIVISION 1 OF ARTICLE VII OF CHAPTER 22 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA (ONE -WAY STREETS) BY AMENDING SECTIONS 22 -451, 22 -452, AND 22 -453 TO CLARIFY THE PROCESS FOR ESTABLISHING ONE -WAY STREETS. BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: 1. That Division 1 of Article VII of Chapter 22 of the Code of the City of Portsmouth, Virginia is amended by amending Sections 22 -451, 22 -452, and 22 -453, as shown below: Sec. 22 -451. - When provisions effective. The provisions of division 22 ..f this article shall become effective as to any one - way street when signs have been provided therefor as prescribed in section 22 -452. Sec. 22 -452. - Authority of city manager to establish one -way street and erect signs. UaLThe city manager is authorized to designate streets within the city for one - way traffic only and is authorized and directed to provide such signs °~ way StFe@ts nwi- as will apprise an ordinarily observant person of such one -way streets. U It shall be unlawful for any person to drive in an unauthorized direction on a one -way street Sec. 22 -453. - Permits for exceptions. When it can be demonstrated to the satisfaction of the city manager, or the city manager's duly authorized representative, that the strict enforcement of the provisions of divis:..~ '' ~4 this article will cause an unreasonable hardship on some particular person relative to the loading or unloading of trucks or other vehicles on such one -way streets, the city manager, or the city manager's duly authorized representative, is authorized to issue a special permit to such person permitting a variance from the provisions of ddivis -ion - ~, this article. Any such special permit shall be in writing and shall specify the nature of such variance and the place and period of time when such variance shall be permitted. Such permit shall only be issued when it can be demonstrated to the satisfaction of the city manager, or 4is the city manager's duly authorized representative, that the granting of such permit will alleviate a clearly demonstrable hardship as distinguished from a special privilege or convenience to the person who sook seeks such permit. 2. That except as expressly set forth herein, Division I of Article VII of Chapter 22 is not otherwise amended.
