(iii) All construction locations, activities and schedules shall be coordinated, as directed by <br />the Director of Development and Permits or designee, to minimize public <br />inconvenience, disruption or damages. Portsmouth shall submit a written construction <br />schedule to the Director of Development and Permits or designee at least ten (10) <br />working days before commencing any work in or about the public streets or public <br />rights -of -way. Portsmouth shall further notify the Chesapeake Director of Development <br />and Permits or designee not less than five (5) working days in advance of such <br />excavation or other work and shall comply with the provisions of the Virginia <br />Underground Utility Damage Prevention Act, Virginia Code Section 56- 265.14, et seq., <br />if applicable. <br />Section 3.11 Mapping. <br />A. Portsmouth shall maintain an accurate map of its fiber optic cabling facilities. Portsmouth <br />shall provide Chesapeake with "ESRI ArcGIS shapefile compatible" as built drawings and <br />an accurate map or maps showing the location of its facilities, including conduit lines and <br />any other facilities requested by Chesapeake, to include a digitized map(s) in both printed <br />and electronic form readable by the current version of Auto CAD certifying the location of <br />all fiber optic cabling facilities within Chesapeake. Portsmouth shall provide Chesapeake <br />with updated maps on an annual basis. <br />B. If any of the requested information of Portsmouth in this Agreement is considered <br />proprietary, confidential or a trade secret, Portsmouth will notify Chesapeake of this <br />opinion and Chesapeake will keep such information confidential to the extent permitted by <br />the Virginia Freedom of Information Act (Vir(yinia Code Sections 2.2 -3700 et seq.) or other <br />suecessor statute or law, as amended from time to time. Portsmouth will submit an existing <br />Facilities Map showing the locations in public streets or public right of way as a condition <br />precedent to Chesapeake's approval of this Agreement. As for new installations, after the <br />effective date of this franchise, Portsmouth shall submit the proposed Mapping of its plans <br />for new construction to Chesapeake prior to any construction. As -built drawings of any <br />new construction of facilities shall be furnished to Chesapeake within sixty (60) days of <br />completion of such construction. All as -built maps and drawings shall be drawn to scale <br />and reference to a physical Chesapeake benchmark to the extent the physical benchmark is <br />in reasonable proximity to Portsmouth new installation. All mapping shall be provided in <br />a format compatible to Chesapeake's present and future mapping systems. Alternatively, <br />Portsmouth will pay for the cost of making the mapping compatible. <br />C. Prior to its installation of any facilities in the public streets or public rights -of -way and <br />after Portsmouth provides Chesapeake with its proposed plans for the facilities, <br />Chesapeake may, in its discretion, designate certain locations to be excluded from use by <br />Portsmouth for its fiber optic cabling facilities, which in the reasonable judgment of the <br />Director of Development and Permits or designee, is incompatible with the proposed <br />facilities or would be rendered unsafe or unstable by the installation.
