R -22 -26 <br />A RESOLUTION AUTHORIZING THE CITY MANAGER TO ACCEPT THE <br />TERMS OF DRINKING WATER CONSTRUCTION FUND FINANCING FROM <br />THE VIRGINIA DEPARTMENT OF HEALTH, INCLUDING FORGIVENESS OF <br />THE ENTIRE PRINCIPAL AMOUNT OF $150,000. <br />WHEREAS, Lead and Copper Rule Revisions adopted by EPA require public <br />water supply owners to develop and implement a Lead Service Line Replacement Program; <br />and <br />WHEREAS, the City applied for low interest loan financing in the amount of <br />$150,000 from the Virginia Department of Health (VDH) to prepare an Action Plan for the <br />Program; and <br />WHEREAS, VDH has notified the City that it is willing to forgive the entire <br />principal amount of the financing, thereby converting the loan to a grant; and <br />WHEREAS, the City is required to notify VDH that it accepts the financing terms, <br />including the principal forgiveness, by no later than December 16, 2022; <br />NOW THEREFORE BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia that it accepts the proposed terms of the Virginia Drinking Water <br />Construction Fund financing proposed by the Virginia Department of Health; and <br />BE IT FURTHER RESOLVED that the City Manager is authorized to so notify <br />the Department of Health and to take such further actions and execute such documents as <br />are necessary or desirable to obtain and confirm the financing. <br />ADOPTED by the Council of the City of Portsmouth, Virginia at a meeting held <br />on November 22, 2022. <br />Teste: <br />City Clerk <br />
