(e) Any building housing live entertainment shall include soundproof <br />entryway and exit doors. <br />(f) Without limitation, prior to initially operating the entertainment <br />establishment a Zoning Permit must be obtained from the Zoning <br />Administrator and a Certificate of Occupancy (CO) must be obtained from <br />the Department of Permits and Inspections. <br />(g) The establishment shall comply with any maximum occupancy load limits, <br />including patrons and employees, set by the Building Official. <br />(h) Live entertainment shall only be permitted indoors and is not permitted on <br />the rear deck. An amendment to this Use Permit would be required to <br />permit outside live entertainment. <br />(1) The maximum illumination of all lighting at ground level at the property <br />line shall not exceed 2 foot- candles to prevent light from spilling out onto <br />the adjacent property. <br />(j) All local, state, and federal licenses and permits required for operation of <br />the establishment shall be obtained and maintained in good standing. <br />(k) The owners and /or operators of the establishment shall not violate any <br />laws of the Commonwealth or ordinances of the City related to peace and <br />good order, nor suffer repeated or chronic violations by any patrons or <br />customers. If the Chief of Police, in their discretion, determines that there <br />are significant violations of this type so as to comprise a significant law <br />enforcement problem, they may notify the applicant in writing and provide <br />a copy of such notice to the Zoning Administrator, which may result in the <br />initiation of proceedings for the revocation of this Use Permit. This clause <br />is not to be construed as a limitation or waiver of any other grounds for <br />revocation of this Use Permit under the Zoning Ordinance or the terms <br />hereof. <br />(1) All taxes /fees associated with the property and/or the proposed use must <br />be paid when due, as determined by the City Treasurer. <br />7. REVOCATION OF PERMIT: Violation of any of the conditions set <br />forth herein may serve as grounds for revocation of the use permit by City Council. <br />ADOPTED by the Council of the City of Portsmouth, Virginia, at a meeting held <br />on September 13, 2022. <br />Teste: <br />City Clerk <br />
