(c) Where required by the Zoning Ordinance, all external site and building <br />improvements, including signage, must be approved through issuance of a <br />Certificate of Appropriateness by the Historic Preservation Commission <br />prior to the commencement of work. <br />(d) Without limitation, prior to commencing operation of the entertainment <br />establishment: (i) a new Zoning Permit must be obtained from the Zoning <br />Administrator; and (ii) a Certificate of Occupancy must be obtained from <br />the Department of Permits and Inspections. <br />(e) The maximum occupancy load of the entertainment establishment, <br />including patrons and employees, shall be in compliance with any limits <br />set by the Building Official. <br />(f) No events or live entertainment shall occur at the entertainment <br />establishment on any Sunday. <br />(g) All local, state and federal licenses and permits required for operation of <br />the entertainment establishment shall be obtained and maintained in good <br />standing. <br />(h) All taxes /fees associated with the property shall be paid when due, as <br />determined by the City Treasurer. <br />(1) The owners and /or operators of the entertainment establishment shall not <br />violate any laws of the Commonwealth or ordinances of the City related to <br />peace and good order, nor suffer repeated or chronic violations by any <br />patrons or customers. If the Chief of Police, in his or her discretion, <br />determines that there are significant violations of this type so as to <br />comprise a significant law enforcement problem, he or she shall notify the <br />applicant in writing and shall provide a copy of such notice to the Zoning <br />Administrator, which may result in the initiation of proceedings for the <br />revocation of this use permit. <br />7. REVOCATION OF PERMIT: Violation of any of the conditions set <br />forth herein may serve as grounds for revocation of the use permit by City Council. <br />ADOPTED by the Council of the City of Portsmouth, Virginia, at a meeting held <br />on October 12, 2021. <br />Teste: <br />City Clerk <br />
