units at 2305 Nashville Avenue, 2321 Jefferson Street, and 2323 Jefferson Street (Tax <br />Parcels 0139 -0830, 0139 -0850, and 0139- 0840), being more particularly described as: <br />UP -21 -10 <br />2305 Nashville Avenue, 2321 Jefferson Street, 2323 Jefferson <br />Street <br />(Tax Parcels 0139 -0830, 0139 -0850, 0139 -0840) <br />ALL THOSE certain lots or parcels of land, with the buildings and <br />improvements thereon, situate, lying and being in the City of <br />Portsmouth, State of Virginia, numbered and designated as Lots 17, <br />18, 19, 20, 21 and 22, in Block 56, as shown on that certain plat <br />entitled, "PLAT OF PRENTIS PARK", said plat is duly recorded in <br />the Clerk's Office of the Circuit Court of the City of Chesapeake, <br />Virginia, in Map Book 13, at page 5. <br />IT BEING all of that certain property conveyed by Deed of Correction <br />from Prolific Properties, LLC to W.I.N. Property Management and <br />Realestate Developement, Limited dated October 25, 2018 and <br />recorded in the Portsmouth Circuit Court Clerk's Office as Instrument <br />Number 180012198. <br />6. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br />(a) The development shall be in substantial compliance with the concept plan <br />entitled Conceptual Devvloptnent Lurout prepared by AEK Construction <br />dated May 2021 and the rendered concept elevations prepared by AEK <br />Construction received June 22, 2021, except where modifications may be <br />required to comply with all applicable local, state, and federal codes and <br />regulations. <br />(b) Townhouse dwelling lots shall be subdivided in accordance with Chapter <br />33.1 of the City Code (Subdivision Ordinance) prior to obtaining site plan <br />approval. <br />(c) At no cost to the City, the applicant shall extend the Nashville Avenue <br />right -of -way to accommodate the driveways of the last two units in <br />accordance with Section 33.1 -43 of the City Code. <br />(d) The development shall be constructed in compliance with all applicable <br />codes, ordinances and regulations of federal, state and local government, <br />and all required licenses and permits shall be obtained and remain in effect <br />during the operation of the development. <br />
