6. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br />(a) The development shall be in substantial compliance with the concept plan <br />entitled A4 Landing at High Street prepared by Hoggard -Eure Associates, <br />PC dated March 19, 2021 and the rendered concept elevations titled High <br />Street Townhomes prepared by Retnauer Baynes Associates, LLC dated <br />March 19, 2021, except where modifications may be required to comply <br />with all applicable local, state, and federal codes and regulations. <br />(b) Townhouse dwelling lots shall be subdivided in accordance with Chapter <br />33.1 of the City Code (Subdivision Ordinance) prior to obtaining building <br />permits. <br />(c) The development shall include streetscape improvements along all street <br />frontages, including those consistent with the current High Street Corridor <br />Multinaodal Concept Plan, subject to any deviations approved by the City <br />Engineer. <br />(d) The development shall be constructed in compliance with all applicable <br />codes, ordinances and regulations of federal, state and local government, <br />and all required licenses and permits shall be obtained and remain in effect <br />during the operation of the development. <br />(e) All taxes /fees associated with the property and /or the proposed use must <br />be paid when due, as determined by the City Treasurer. <br />7. REVOCATION OF PERMIT: Violation of any of the conditions set <br />forth herein may serve as grounds for revocation of the use permit by City Council. <br />ADOPTED by the Council of the City of Portsmouth, Virginia, at a meeting held <br />on June 22, 2021. <br />Teste: <br />City Clerk <br />
