(a) The development shall be in substantial compliance with the concept plan <br />entitled "A4 Acres at Greenwood Preliminary Site Plan" prepared by <br />Hoggard -Eure Associates PC dated February 12, 2021, the rendered <br />concept elevations titled "A4 Acres Apartment Elevations" prepared by <br />Retnauer Baynes Associates, LLC dated February 10, 2021, and the <br />rendered concept elevations titled "A4 Acres Clubhouse Elevations" <br />prepared by Retnauer Baynes Associates, LLC dated February 10, 2021, <br />except where modifications are required to comply with applicable local, <br />state and federal codes and regulations. <br />(b) The development, at no cost to the City, shall comply with the <br />recommendations included in the Traffic Impact Study prepared by <br />Intermodal Engineering, PC dated February 11, 2021 as approved by the <br />City Engineer, whether on -site or off -site, including: <br />i. A 75 -foot eastbound left turn lane with a 100 -foot taper on Greenwood <br />Drive at Wynn Street access. <br />ii. A 50 -foot eastbound left turn lane with a 100 -foot taper on Greenwood <br />Drive at Tazewell Street access. <br />iii. The level of Service D for northbound traffic on Tazewell Street and <br />Greenwood Drive is caused by cut - through traffic from Cavalier <br />Boulevard to Greenwood Drive on Tazewell Street. Implement signal <br />timing improvements and modify the northbound left turn lane signal <br />head to a "protected- permitted" phase by implementing either a five - <br />section signal head or a flashing yellow arrow operation to allow for <br />permissive northbound left turns. <br />(c) The development shall be constructed in compliance with all applicable <br />codes, ordinances and regulations of federal, state and local government, <br />and all required licenses and permits shall be obtained and remain in effect <br />during the operation of the development. <br />(d) All taxes /fees associated with the property and /or the proposed use shall <br />be paid when due, as determined by the City Treasurer. <br />7. REVOCATION OF PERMIT: Violation of any of the conditions set <br />forth herein may serve as grounds for revocation of the use permit by City Council. <br />ADOPTED by the Council of the City of Portsmouth, Virginia, at an electronic <br />meeting held on April 27, 2021. <br />Teste: <br />City Clerk <br />
