R -21 -35 <br />A RESOLUTION AUTHORIZING VARIOUS REAL PROPERTY CONVEYANCES TO <br />THE COMMONWEALTH OF VIRGINIA, ACTING BY AND THROUGH THE <br />VIRGINIA DEPARTMENT OF TRANSPORTATION, IN FURTHERANCE OF VDOT'S <br />CONSTRUCTION OF SOUND BARRIER WALLS ALONG INTERSTATE -264. <br />WHEREAS, the Virginia Department of Transportation intends to utilize federal funds <br />to construct sound barrier walls along I -264 (the "Project "); and <br />WHEREAS, in furtherance of the project, VDOT has requested conveyance of the <br />following property interests from the City (the "Property Interests "): <br />and <br />(1) All right, title or interest of the City in or to an area located south of I -264 and <br />north of Trexler Avenue, beginning just north of Downes Street and extending <br />approximately 470 feet to a point approximately 155 feet west of Dahlia Street N <br />containing approximately 1,775 square feet; and <br />(2) To the extent of the City's right, title or interest, two permanent drainage <br />easements located north of I -264 and south of Choate Street: the first being <br />located 535 feet east of Rodman Avenue containing approximately 397 square <br />feet, and the second being located approximately 300 feet west of the aerial <br />portion of the pedestrian bridge over I -264 that connects Manteo Street and <br />Choate Street and containing approximately 396 square feet; and <br />(3) To the extent of the City's right, title or interest, four temporary construction <br />easements: the first being located south of I -264 and north of Trexler Avenue and <br />beginning approximately 185 feet west of Arcadia Avenue, and extending east to <br />a point approximately 50 feet west of Dahlia Street N., containing approximately <br />16,062 square feet; the second being south of I -264 and north of Duke Street, <br />approximately 215 west of Pulaski Street, containing approximately 280 square <br />feet; the third being south of I -264 and north of Race Street beginning <br />approximately 160 feet west of Richmond Avenue and extending east to a point <br />approximately 15 feet west of Richmond Avenue, containing approximately 1,802 <br />square feet; and the fourth being north of I -264 and south of South Street <br />beginning approximately 170 feet west of Des Moines Avenue and extending east <br />to a point approximately 62 feet from Des Moines Avenue, containing <br />approximately 1,090 square feet; <br />WHEREAS, the Project will benefit the citizens residing near the I -264 corridor; <br />NOW THEREFORE BE IT RESOLVED by the Council of the City of Portsmouth, <br />Virginia that it approves and authorizes the conveyance of the Property Interests to the <br />Commonwealth of Virginia, acting by and through the Virginia Department of Transportation, <br />together with such similar interests in the area of the Project as may be necessary or desirable in <br />further of completion of the Project, and that the City Manager is authorized to execute such <br />
